Housing benefit claim stopped with no explanation

Hi, sometime last year I was overpaid on my housing benefit due to an error on the UC admin side rather than my own error. I informed them of the overpayment and they sent me a document stating how much I was to repay which has resulted in me being in debt of several thousand. They take a certain amount each month out of my UC as part of the repayment.



Since then they have stopped my housing benefit altogether, rather than adjusting for the correct figure. I have been asked to bring in numerous documents to prove what rent I am paying and that I am indeed the rightful tenant of the flat, but this has so far not got any results. This has been ongoing for almost a year, and every time I have phoned UC they say they will escalate higher up the chain but so far there has been no resolution, and I haven't been able to get straight answers as to why my HB has been stopped or even if I still definitely have a live claim.



Any advice appreciated.

If asking for a PIP MR should I Justiffy existing mobility award?

Hi folks,

If I do decide to go down the road of asking for an MR for the daily care part of pip (Got 7 points) should I also try to justify why the Mobility standard award should still stand (got 10 points on that) I understand they can stop what I have already got.


The assessor did make a few mistakes on the Mobility, noting on the justification part of the assessors report that I had numerous accidents instead of the one that I specifically mentioned.

The decision itself is right I feel, as I am registered partially sighted, so I got the 10 points, but the assessor did mention numerous accidents, which was wrong but at the same time did seem to base the points on my eyesight ability.

So if I do ask for an MR, got just under 10 days to do so, should I stick specifically to the Daily care on justify why I should hold to what I have got as regards Mobility?

I just wanted to say thanks to Alice, Poppy and everyone else for their helpful advice which helped me write the MR stating particular criteria. Now back in SG.

ESA rapid reclaim or UC?

This is just a hypothetical question for now.

If someone came off ESA to attempt to work and within 12 weeks realises they can't manage it, would they still be able to do a rapid reclaim for ESA or would they have to claim UC?

Assume a full service UC area and ESA IB Support Group.

Me partner not working on tax credits with 2 disabled children getting child tax credits only. Can we apply for council tax reduction without going through universal credit.
2. My partner is looking for work again (he lost his job a months before the universal credit roll out here) will this move us onto universal credit.

We have applied for free school meals for the kids.

Hi, my son will be finishing further education in September and is 19 years old. He has registered for job seekers allowance. I have just been informed by the council that my council tax will be increased from £15 p/m to £105 from September. I only work 16 hours a week as I have one other dependent. Could anyone please let me know if that is correct as I'm not technically any better off as I will be loosing any money I currently get for him including child benefits,

My son who is 16 and attending a training centre so he can get an apprenticeship has gone to live with his friend (which is also his step brother but me and his dad broke up )

The adult of the house is receiving pip and has just put a claim in for Universal credit
my son is to be her carer (he does lots for her )

they went to find out what do about money for my son and was told for him to put a claim in for universal credit ?

I assumed she would just claim his tax credits and child benefit ?

can anyone advise? also will he be entitled to carers allowance? will this go to her or him ?

Hi, Just wanted your thoughts on this scenario.

A couple rent a property together for 9 months in Scotland (before that, they lived apart). Let's call them Bill and Sally.
Sally moves out to take up a new job in England (300 miles away).
Sally rents a new property and signs up to pay council tax and applies or single person discount, She also updates her bank, hmrc and new job with her new address details. This is now her main residence.
Bill now lives alone and applies for single person discount in Scotland.
Council in Scotland say: "You are not entitled to single person discount because you are in a relationship with Sally".

Does this sound fair? I'm finding it hard to understand.

Universal Credit To-Do-List on my Account

Hi there, basically I’ve put a claim in for Universal Credit and tomorrow need to ring the contact number to arrange my appointment. Basically I’ve noticed on my to-do-list there’s a section where it asks about my earnings at on my last job and one of the questions is;
‘In the 12 months before your job ended, were there any gaps in your employment?
This doesn't include paid holidays, maternity or paternity leave’.

I was only working for 3 months and before that I was on my college course and didn’t work. It’s a yes or no question so would I answer it saying yes?! Because of course there were gaps because I only did work experience for my college course and didn’t have a job.

There is also a section titled ‘preparing for your commitments meeting’. So I was wondering does both the past job earnings section and the other section mentioned need to be completed before I attend my interview for my claim with my work coach?!

HELP Need some Benefits & Housing Advice

Hope I can get some help,
I used to live with my family but my mum recently passed away. We live in rented accomodation and she was on HB.
I now have to apply for the tenancy to be transferred to either me or my sister. If I transfer it to me i wont be able to afford the rent or qualify for HB because I work, My sister who cant work due to her learning disability may get HB.
The landlord is suggesting due to her reduced life expectancy it should be transferred to me . If I follow their advice and take over the tenancy could my sister will qualify for HB for the rent, or will she only get part of it,
I tried asking the CAB for advice but they were asking me to get legal advice.

PIP Face to face Assessments/ Is there a desk in the room?

When having a PIP Medical assessment, interview with the Medical practitioner,

ATOS,

On the day of the interview, when you are in the room having it, is there a desk there, where you can lay any notes, and recorder (after recording permission has been granted by them of course)

Do they have desks? or not?

JSA and Habitual Test

Hi guys
I used to claim JSA (income based) for 2 months in July 2018 I went on holiday for 2 weeks and I closed my claim. Once I get back I made a rapid claim online and I wait for an interview.
I re-arrange 3 appointments in JC because of job interviews and I provide my work coach with proof of my interviews. Finally I got my interview and they asked me to Habitual Resident Test which I've done on 15th May 2018 - less than 3 months.
Somehow I still keep the copy of me previous HRT and I call them to ask why I need to do it again, the lady on the phone said she don't see a reason why I need to do it again but she advised me to ask my local JC. I went on the day and anyway I provide them with 5 months bank statement, 3 forms of ID, Proof of NIN, Flight tickets and they still require utility bills.
I live in the UK since 2013 - I'm Bulgarian national and the fact I had 3 interviews and I'm trying to get work so hard prove that I really don't want to be on benefits but being outside the UK for 2 weeks and having my HRT test less than 3 months ago and attending my last appointment 1 day before i went on holiday is it enough for them to know I'm not here for purpose of benefits and I'm resident since 2013

That's the worst nightmare in my life experience I'm feeling discriminated

Have DWP stopped doing ESA work focused interviews?

I've been on the ESA work-related activity group benefits since 2012 I think and had a work focused interview every 6 months on January and July. But this year's January and July I've had no work focused interview appointments and the benefits still come through regardless. Have they stopped doing it?

Atos cancelling appointments Twice? (HP Sick?)

Heard people having their Atos assessment appointment being cancelled on the last minute (Atos saying the assessor has called in sick)

and some people have even had it happen to them twice (2 appointments cancelled)

1) What is this about? they are purposly messing claimants about?

2) As your allowed to change an appointment date once, if you cannot attend the first one,
Are these 'atos' cancelled appointments, considered as 'one your your' allowed changes to appointments?

3) Is it common for Atos to cancel these appointment with their excuses, cancelling on the last minute,

and then the DWP Stop your benefit, by DWP stating that you missed an appointment
(which is nonsense, as the truth is that Atos cancelled the appointment due to the HP being sick)

4) is, can this Twice (or more) cancel of appointments just be a ploy to stop your benefits

5) Has this happened to you? what was your outcome?

National Insurance credits when separated

Hello, not sure if I am on correct forum page.

My husband and I separated 21 years ago and are still married.

My own National Insurance record currently stands at 25 qualifying years so I am 10 years short, though not due to retire until 2034 :(

I am not working and do not get any benefits myself - my current partner is retired and gets Pension Credit Guarantee Credit - so I do 'benefit' from free prescriptions and dental, plus council tax benefit.

A friend said I could claim on my husband's pension to make up the shortfall? This surely isn't the case is it?

I feel my only option, when possible, is to pay to top up my qualifying years.

Any advice would be gratefully received.

I hope you will excuse me for asking yet another question on PIP descriptor Mixing with people..


Does this descriptor simply take it into consideration a persons social ability to mix, or can it also include things like not recognising people due to eyesight difficulties, and the problems that lead on from that?

Hello.

Just a quick question because I got scared and I don't want to get too happy for the extra help just yet. I checked my bank account and I've been awarded SDP ontop of my ESA payment. But also got a second payment which equates to a years back pay. I did a quick Google and apparently they backdate it to when your PIP started?
, is that what that payment is? In got scared that it's some sortve mistake.but now I'm wondering if it's that and it's not a mistake?

Returning to work PT after maternity leave

Hello everyone!

I'm returning to work on 10th September on a part-time basis, this is 2 days a week 16 hours all together. I earn £10 an hour, and have checked on entitledto and along with my husbands income of 18k a year we should be entitled to some benefits.

I have a quick question though - when can I actually apply for these? Can I do it now, knowing what my earnings will be from next month or do I have to wait until I'm back at work? Just worried there might be a delay and we'll struggle without the extra money from benefits.

Paying in to a private pension

Hello everyone,

I am 31 years old and on income related ESA, as well as DLA.

I know that anything over £6000, as well as any income (including from at least some pensions) counts towards how much many I can receive. My question, however, is am I allowed to pay into a private pension fund monthly for when I retire? Or is that not allowed, unless it was one I couldn’t withdraw from until a certain age?

Also, if it is allowed, and I do it, do I need to let the DWP know?
