PIP Appeal overturned by change of circumstance?! HELP

Help appreciated. My friend was awarded standard Daily and standard mobility via a tribunal which she won, she was awarded both of these rates indefinitely.

6 months later she became more unwell with her mobility and care so she contacted DWP to inform them of a change of circumstances. She asked for a review form but they insisted on sending her a completely new application - im not sure why?

she sent off the new application and got a call from a decision maker to say she had been awarded the higher rate mobility but the daily living rate remained as standard. This all seems fine BUT they have only awarded her these rates for 12 months, with a review every 12 months.

I dont understand why she was previously awarded both elements indefinitely on appeal and now the time scales have reduced significantly. The added fear is her age, at 62 she needs to be awarded PIP indefinitely in order for it to help her after she is 65.

Can DWP overturn an appeals award decision? Especially if the original conditions remain but she now has more permanent mobility issues?

Advice appreciated. We want to try to avoid another lengthy appeals process but fear it may be the case.

Can Esa (CB) trigger UC?

Hi folks,

I am on ESA (CB) and going through the assessment process again, ESA50 sent away.

I am in support group.

If I was placed in wrag this time, I understand contribution based ESA only lasts for a year, 365 days
.
However if my condition got worse after the year is up, would it trigger an Universal credit application first to get the money for ESA reinstated.

I am not entitled to Universal Credit.

Thanks for any clarrification.

I need to know if its 'normal' to have to wait for the PIP tribunal to organise a date for the impending reappraisal of my PIP claim. It has been nearly a year now - from the first request to be reappraised due to health deterioration and after the MR in March I have heard nothing. Except for the fact that my local MP has written, my dr has written, I have rang and rang but nothing. Is it therefore to be expected that I have to wait this long - whilst health is going down the pan - and time is running out.

Housing Benefit 4 Joint Tennants

Hello,

Usually a couple have a property as single or joint tenants, however I understand you can have upto 4 tenants at a property.

With housing benefit with a couple each one has to apply a separate application and I guess with 4 tenants as well.

So, say 3 tenants get 100% housing benefit and 1 tennant works part time or income is varied how does that work out?

Hi all, I submitted a UC appeal to the tribunal back in the middle of May. As I was put in WRAG and not Support. It took ages but I did get my bundle of info back from the DWP. Now I am asking what do I do next?
Do I need to post this bundle to the tribunal? Do I keep this bundle for my own records? Has the DWP forwarded the same info the tribunal as they've sent me? thanks.

ESA f2f assessment cancelled by Maximus confused

Hello All,

I've already started a thread with regards to claiming esa. Filled in the esa50 form asked for a home f2f assessment, send doctor's letter of evidence. Maximus lied several appointments was cancelled by them they've even lied why the appointments was cancelled blamed broken recording machine but the re-scheduled letter never mentioned why the appointments was cancelled. Got more stressed because of them I made a complaint direct to the main company Maximus and not CHAD whatever they are at Wembley stating they way I was being victimised, disadvantaged, discriminated under the Equality Right Act etc as well as the Fraud Act 2006 and that I have recording of all the telephone conversations with them.

True to their word they cancelled the last appointment if they did not make a decision about my complaints, they've reached a decisions blamed the DWP and sent esa50 form back to the DWP, received a letter telling me the ESA assessment has been cancelled altogether for me to ring the DWP which I do not intend to I'm still recovering from all the bad treatments I got with their harassed letters and phone calls. I'm on Income Support so my money is still going in my bank been for few weeks now. I have not heard anything from the DWP as yet.

I'm also now on phone appointment with my gp, on phone appointment with psychiatrist.

My question has anyone had their esa f2f cancelled and files send back to the DWP and what outcome did they receive?

Thanks

How To Tell A Work Coach I Was Sacked When Making My Claim

$

Hi there I was wondering if anyone could give me advice on this matter. Tomorrow I will be applying for Universal Credit and I’ve heard that usually on the application they will ask about employment history and why you left etc. I was basically let go of during my 3 month probation for very very minor reasons; my manager put it down for me not suiting the job role. There was no misconduct of any kind. She praised me a lot. Tbh, I think the real reason I was sacked was because of cutback problems and because I didn’t want my hours decided (I was on a 12 hour contract and didn’t want it reduced anymore).

My question is this; how should I word this on my application and in person to the work coach?! Because I know they’re the ones that pass the information on and depending on how you’ve explained it, you can be sanctioned....I’ve heard. But I must add I have been sacked 6 months, so it has been a very long time.

I was going to say something along the lines of ‘I was Let Go of before the end of my 3 month probation period because my employer felt I didn’t suit the role’. Then when they ask for further details I’m going to have to be truthful and say I don’t know the full reason they thought this. All I remember my manager saying was about my speed with some tasks. But the thing was I wasn’t fully trained anyways. I was employed during the Christmas season when it was very busy and they couldn’t give me full intense training (it was my first ever job). Btw it was a retail job if that matters.

Please, any advice you give me would be much appreciated. I just want to try and avoid getting sanctioned as much as I can, because I don’t believe I should be sanctioned for such really really minor reasons that weren’t fully explained to me tbh either. But I know this is down to a decision maker but still.

So its been 4 weeks ( july 13th ) since I've won PIP TRIBUNAL. Original got 0 points for mental illness. And It took me around a year to wait for the tribunal and they awareded me 10 points. I did phone them one week after i won and they did say its on the system. I also rang them few days ago. They said someone will phone me it normally takes 6-8 weeks. But the judge told me 4 weeks I should hear back. Why is no1 on ringing me. And also when will they back pay me after I get the phone call how long does it take?

SSP, Holiday Allowance and a Car Accident

On the first day of our holiday a car went into us.

We were walking wounded but still needed a trip to the local hospital. We were on our way to Trecco Bay caravan park in Wales from Sheffield. We were about 10 mins away from the site when it happened. The accident happened on the approach to a roundabout, the other driver foot got stuck on the accelerator and instead of following the curve of the road as he came off the roundabout he went straight across and into the front side of the car.

We had our two young children with us (3 at the time and a 6 year old). They had bruising from the seat belts and were shook up from what happened. The dashboard collapsed on my husband's legs, luckily it only caused bruising. The impact from the air bag caused my face and lips to swell up and I had a seat belt burn. We both have general aching in our backs, shoulders, neck and chest, etc. My husband suffered more because he was driving and the car went into the driver's side.

A sick note from the hospital was not on our minds at the time, just getting safely to our caravan was the only thing really on our minds. It was late at night and the kids were tired and hungry.

My understanding is that if you are sick on the first day of your holiday you can claim SSP instead and use your holidays another time?

My husband has just been signed off for work for 2 weeks but they GP said they can't back date the sick note. We didn't get anything from the hospital. So looks like he will lose his holidays. Or is there anything that can be done? His GP just said she couldn't back date it and that was it. My husband also didn't self certify to his employers other than telling them he had an accident the following day and you can only self-certify for 7 days and the accident happened on the 3rd of August and he was meant to be going back to work tomorrow. There was probably things we were mean't to do but being so far from home with no luggage, car or family/friends to help we didn't really think about things like losing holidays.

Resignation

Hi all. I’m looking for some advice regarding benefits.

I recently quit my job due to certain trust and respect issues with management. Browsing the inet I know that because I’ve resigned with what I imagine isn’t a reasonable reason I am unable to claim JSA for up to 6 months. What I’m wondering is should I inform the DWP now that I have resigned (officially 8 Aug last day) or should I wait till closer to the 6 months since this date.

All going well I’ll be in a job in a couple of weeks but best to be prepared and informed.

Thanks for the help and info. !!!128076;

Missing Payment

Hello. Hoping someone can put some light on a issue. Basically, someone I look after was due to be paid state pension today, it wasn't in the Post Office account (Card account) and upon speaking to the Pension Service they confirm payment was sent and has been made. They've advised waiting 48 hours, as until that time has lapsed they can't do anything. At which point, they've advised they'll investigate. However, they've said the payment was sent and shows no issues on them system. Problem is, it's left this person without any money and they are saying wait 48 hours which they'll investigate, but what about a payment. Called Post Office, far as they are concerned no issues with accounts today. Any ideas / thoughts. Thanks in advance

Paid enough NI to be eligible for Contributory based ESA.

My wife recently had a letter back from the DWP stating that her ESA will be discontinued, stating that “we cannot pay you because you have not paid, or been credited with enough National Insurance Contributions” “We have used the tax years ending 5 April 2012 and 2013 to assess your claim”.
In years 2011-12 and (2012-13)
The NI LEL was £102 (£107) per week
50x the LEL was £5,100 (£5,310)
In 2011-12 my wife had moved work and had a break between meaning she worked a total of 35 weeks that year and was paid £7,186 before tax for the year. (average £205/week over the 35 weeks)
In 2012-13 she had to finish work due to arthritis meaning she worked a total of 36 weeks that year and was paid £6,205 before tax for the year. (average £172/week over the 36 weeks)
Please can you advise if this is sufficient to comply with both the Contributory Based ESA National Insurance requirements as stated below. I don’t quite follow what they both require.
• First contribution condition - in one of the last two complete tax years, you must have paid Class 1 or 2 contributions on relevant earnings at the lower earnings limit for at least 26 weeks. This means you must have worked for at least 26 weeks of the last two complete tax years; and
• Second contribution condition - in both of the last two complete tax years, you must have paid or been credited with, Class 1 or 2 contributions to the value of 50 times the lower earnings limit.

I assume the first one means she must have been earning at least the LEL for 26 weeks per year.
I assume the second means that overall she needed to earn at least 50xLEL over the whole year.
If this is the case then as far as I can see she complies with both.
Please advise

Hi, this is my first time posting here but always lurking, i wonder if you can give me some clear advise.
My sister has won a large sum of money and gifing me 5k to be debt free at long last, its life changing for me and for her to be honest. I currnetly work 30 hours a week and recieve wtc and ctc and hb, not a a mssive amount but it keeps me and my son in a house and pays the bills...... i have one child whos 15 and my daughter is 18 but works, she also lives at home.
. Anyway my question is what do i do as i know i have to declare it but as its under the 6k will it affect my benefits, i will only have it for one day and then will be paying off my overdreaft and cc etc. should i ask her to pay off my debts so it wont go into my account at all, please no judgement but welcome all the answers.
Thanks :)

NHS maternity exemption

Hope I'm posting in the right board, I'm looking for some advice for my friend who had a baby last year. Her maternity exemption expires this week but the baby was premature so actually turned 1 a few weeks ago. As she believed her card expired this week she booked in last week for a filling that needed doing. At the end of her appointment the receptionist argued that the treatment wouldn't be free as they go off the baby's birth date so whilst there my friend called the NHS to confirm she was still entitled. The person she spoke to assured her she was still covered for dental treatment till the expiry date on the card, so the receptionist let her leave.

She has been contacted by the dentist today who have again told her she is definately not covered so she needs to pay the £60 due immediately which is money she really doesn't have right now. Every penny is spoken for until she returns to work in September and gets paid. She contacted the NHS again and has now been told different information, that the dental exemption expires on the baby's birth date. Surely there must be lots of babies born prematurely but I can't seen to find any information online about the early expiry if your baby is born early. Seems really unfair that she had not been told about this and there is no information online. She wouldn't have bothered with the filling if she'd known as its already fallen out once and is causing her endless trouble but was fine before.

Does anyone have any more information on what she can do in this situation, with getting two different answers is it worth her calling again or putting in some kind of complaint? She has offered a payment plan with the dentist but they've just said they want their money. Thanks in advance.

Esa form and pension

Hi I'm sorting the form for my husband. It asked about pensions. I get the normal opt in work pension certain % of my wage which increases each year. Think it's the standard one all workplaces had to offer. Is this the occupational pension that the form mentions. I've looked on Google but struggling to figure it out xx

ESA SDP claim - 3 months on!

HI,
I was just wondering if anyone knows how long it takes from your claim being passed to a decision maker to you getting a letter/hearing about the decision?

Claim first went in in May. Was told payment would be in within 5 days. When nithing went it, several phone calls later I was told someone should have called me and I'd get a call back. No call back. When I finally do get one (after more chasing) I am told they want a copy of my tenancy agreement.

No problem, sent off. Took two more phone calls (one I was on hold for 2 hours before the line was cut off at closing time- because I was told I'd get a call back within 3 hours and if I didn't to call back straight away). They tell me they received the documents but are running behind and to call back in a weeks time.

It took 2 weeks of intermittent phone calls to establish that it had gone to the decision maker (over 3 weeks ago now) and they are allowed 6 working days, then I should hear.

Been on hold trying to get through this morning for 90minutes before giving up.

Anyone know how long it takes to hear? I get scared to call and pester - one of the women I got on the phone told me I wasn't a priority as at least I was getting money and they were needing to sort people who hadn't had any money since March :( so it's put me off ringing to enquire as much.

Hello,

Phoned Tax Credits last week to query the progress of finalising last years award.

Told to phone this week when 8 weeks was up.

Before I phoned thought I would join Government Gateway to check last night.

On there it says will be completed by 30th November!

Surely this cannot be right?

Any advise appreciated.

Thanks.
