Hi All, I just started a new job recently. I received my first paycheck last week. I was payed significantly more in tax than I thought I would.

I think this is because I didn't hand my P45 in and maybe HMRC didnt get the correct number code in. My question is , will I get the money back once its resolved? And, will I buy overcharged again next month? How long do these things take? Thanks

Universal Credit migration

Hi
Just wondering if anyone can help.
I have just been forced to move to a new area because of needing an adapted bungalow.
This area is a full Universal Credit area.
Before I moved I was on PIP both enhanced rates
ESA with the severe disabled bit included.
When I moved I was FORCED to move onto UC got told my ESA would stop and I wouldn't get any money so I applied.
I now have universal credit which is drastically reduced by £52 A week.
I thought they did a transition protection guarantee
I have read it here
Who is protected?

Anyone who is moved by DWP/HMRC (called managed migration) to Universal Credit from a legacy benefit after July 2019 without a change of circumstances should not lose out in cash terms according to the commitments given by DWP.

Protection is also extended to cover:

***Individuals who live alone with substantial care needs and receive the Severe Disability Premium will not be moved to Universal Credit until they qualify for transitional protection. Claimants who have already lost this premium as a consequence of moving to UC will be provided with an ongoing payment and an additional payment to cover the period since they moved.***

Wouldbi come under the starred category?
If so why did they force me to move over?
Any help or advice would be great

Booted off my ESA and told to claim UC

Hi people, please be gentle, my first post here and I really do not know what to do for the best.

In short, last September of 2018, my girlfriend wanted to stay with me for so many days in the week as she wanted to go to Uni, if she were to go there from her home (she lives with her mother and is registered there) she just could not go from her house as she has cerebral palsy and scoliosis so the 2 and a half hour drive would have been to much for her, so me and my mum thought it would be good for her to stay with us for her Uni days and then return home for her free days, of course a odd day or 2 for personal reasons with me at my home.

So, I receive, did receive Income based ESA and the SDP, I have my own disabilities too and can not work because of them. I get PIP, both are the low rates in each area, my mum receives her state pension as she is 80 and gets Attendance Allowance. My partner gets DLA only, no ESA or UC.

All was good, the council stated as my mum gets AA, my partner could stay for however long she want's to and I did let the ESA and PIP team know as I stated when my partner is with me she also helps in some of my disability needs. Then 3 weeks ago I received a call from the ESA team stating that I could claim, are entitled to the SDP rate along side my ESA, I was delighted of course.

However, they phoned again wanting more info about myself, I guess to do with the SDP rate, they asked me, so, who lives with you? I was honest and stated my mum and my girlfriend, but my girlfriend only stays so many days during the week for her course as she just can't manage it if she went from her home as it'll be a 2 and a half hour drive away, where as it is only about 50 minutes from my home, so if myself and my mum said no, she would have missed out on a BIG life opportunity, the woman I spoke to seemed to not care about what I stated and said, sorry, we will stop your ESA, just on a temporary basis until we receive a ESA information form that we will send to you, then send it back. I sent it back and they released my ESA money again for that week. Then I received a SMS text message stating, we are looking at your claim and will make a decision in 2 weeks time, we will text you to let you know the outcome. I thought that was weird, so I phoned them again and asked, you have got the info, what the heck is this decision about? They said, oh, they only want to know the details on your girlfriend only, so I thought that was ok and hung up. The next day I receive another SMS text asking me to call them, which I did, they wanted to know what the dates were that she stayed while at UNI, the dates that she broke up from Uni, I quoted that she broke up on the correct date, that she returned home and is living with her mum again until she goes back to Uni around September 23rd, they said, well, please tell us then when she returns, I stated that I would.

I asked again, what is this decision about as I am very worried now that my benefits may change, but they still claimed that my benefits were safe, nothing would happen to them and that the ONLY THING that would come out of the decision was that if I, the info that I gave them about my girlfriend was true (it was) that she paid for her own food, that she did not have to pay rent as my mum was getting the full rate of rent paid as she was getting AA and that she did not give me 1 single penny towards anything else, and they I hung up, with so much relief.

They paid me my back dated SDP rate, BUT I noticed for that Friday that they did not pay me my SDP rate for that week, so I phoned them to ask why? I got a guy who stated that they should have, but the dates got all mixed up and that he just released the payment for that day and told me that the money would be in that day, or by 12 mid night. Next day, Saturday, nothing, I waited until Monday and called ESA again and asked why it had not gone in yet? A woman stated, sorry, you do not get ESA anymore, I asked why? She stated, I can't speak to you about it, again I asked why? Because surely you must send a letter out, her reply, go and claim Universal Credit, I stated that just put me out of my misery PLEASE! but got no answers.

This time, I was worried, and I mean very worried and nervous, so much that I was physically sick 3 times. I phoned the UC line to try to get a few answers but they did not know nothing, 6 hours later, stuck in a few phone calls to ESA again and UC people I was still going nowhere, so I hung up and sent my MP a phone call saying what happened, even she stated that they should not have lied to your face/voice and that she will try to get me answers.

Now, I am a nervous wreck, I was told a while ago, if I needed to claim UC when it all goes live in my area that they would transition me over and I'd have nothing to worry about.

I looked up all the triggers that may have caused this and none of them involved my girlfriend staying for so many days a week to go to Uni and nothing else to do with money, as I do know that if she, for example, paid for my internet and phone bill per month, then that money I would have used, I would have saved it, thus that is a trigger and possibly fraud, however, nothing like this has ever happened since she has been here like that. She can't claim UC as she's a full time student and now I'm threating that if I do have no options but to claim UC they may want her and me to claim as a couple, but, we do not live together as a couple, her purpose here is only! to go to Uni.

Please help someone, my mind and health is already going downhill with all this worry, do I have a right to appeal the ESA decision? My partner has stated that if in the end they did that because of her that she would move out and live in student accommodation so that things will hopefully be ok.

Recently got fired - I have a Job Seekers Allowance Question

I do apologies for this thread but I've been trying to get through to my local job seekers office for almost an hour now.

I got fired from my job for nothing serious. It doesn't bother me, but I'm now actively looking for work and wondered what my options were , if i had any, with job seekers allowance.

I would qualify for everything, including the fact that me & my fiance has less then £5,000 in savings apart from the fact that my fiance works 30-40 hrs a week.

Would i still be eligible to JSA? or no because of this?

Will it affect my benefits?

My husband and I receive child tax credits, he works full time and me part time, now for the past couple of years my parents have their post sent here and they are on the electoral roll at mine and my husbands address, changed their drivers licenses to this address as well.. however they don’t actually live here. They are retired and travel for 6-9 months of the year, they sold their home to fund this, and the rest of the time they stay in their camper van in our garden. The only thing they pay for is the electric they use, they don’t pay towards any other bills etc so I was just wondering where I stand really with regards to benefits, they don’t live with us but on paper they look like they do. Any advice greatly welcomed thank you! :)

Hi!

My OH's payslips show that his total gross and taxable gross figures are the same but he pays into a company pension, so when I renew tax credits am I meant to deduct the pension contributions from the figure they hold as I thought the taxable gross and total gross should be different.

Thanks for any replies.

ESA and disability premiums questions.

Hi,

I wonder is anyone can help please?

I am just about to apply for ESA due to my chronic long team disability as I am no longer able to work at present, I hope this will once again change in the future.

I have been trying to work out my position and feel that I fit the support group criteria for income related ESA, I have a few questions if anyone can please help?

Background - I live alone with my 9 year old son in private rented accommodation, no one receives carers allowance for me. I currently receive the standard rate of both daily living and mobility for PIP.

1 - During the 13 week assessment phase is the additional £16.40 enhanced disability premium also paid or is that only paid after the initial 13 weeks?

2 - If placed in the support group, as no one receives carers allowance, I am in receipt of the standard amounts for both components of PIP and I live alone, will I be eligible for the severe disability payment?

3 - If I am eligible for the severe disability premium do I apply for it separately or will it automatically be applied? If I am eligible for the severe disability premium does this mean the enhanced disability premium them stops?

Apologies for such a long post and so many questions, I would really appreciate any help and advice,

Milly x

UC- expected hours of work

Hi

I have just been looking into UC as not paid much attention to it and the area I live in UC is in force. I might be moving to a different district and UC comes into force on 28 November.

I am a single mum and work 20 hours a week. When I entered my details on entitled to it stated I would be £11pw better off on UC. However when I have gone onto a Gov.uk website it states that people with children are expected to work a set amount of hours. My daughter is 7 and it states I would be expected to work 25 hours a week.

I entered 20 hours a week on entitled and it stated I would be better off on UC - how is this so?

Is it correct that once I am switched over to UC I will have to work 25 hours (and then 35 once daughter 11)?

I have no qualms working the extra hours I am grateful for the help I get and am aiming to be working full-time when daughter in high school. Its just before then I am thinking about childcare if moving areas.

Thanks

Hi,

I was on ESA but it was stopped after an assessment. I appealed the decision 7 months later. Whilst preparing my appeal I was advised to apply for UC.

Now ESA and UC don't know what to do as apparently I cant be transferred back in to UC.

UC have asked to have no part in this issue but have said that I need to do another assessment.

Please advise on what I should do ?

Im in Birmingham I think the system is full blown UC

New Pip assessment - questions

Hi all!

I am up for a pip assessment relatively soon.

At some point since my first assessment (two years ago) one of the checkboxes that I ticked on my assessment form became incorrect (not sure when). I only discovered this since yesterday. On my second assessment form I corrected this mistake but I should have informed them earlier. What are the potential consequences of this? I may have enough points for daily living/mobility anyway. Should I hire a lawyer? I might have actually told them but I can't remember.

Relatively recently I also received several visitors and this forced me out of the flat which I would not normally do. I became very ill as a result of this but I am concerned that somehow they will find out about that and that and they will try and punish me by saying I left the flat when I shouldn't do.

It is also a long time till the appointment and I am pretty worried about it. Any advice?

Hi,

This morning i received a tax refund from HMRC, as i have paid to much tax on my earnings when i shouldn't of. I contacted the carers allowance department and they have suspend my payments while they investigate, as they think i have been overpaid however my net pay is under their thresh-hold because I've been paying tax. Can they claim it back from me as i was not at fault?

Moving from Tax credit to UC

Hi,
I was made redundant whilst pregnant with my first child (1yo) so claimed tax credits. I'm now due my 2nd child so used entitledto website to see if there will be a change in my tax credits.

My area moved fully to universal credit earlier this year so I'm wondering if I notify them of a change ie 2nd baby that means I will have to move to universal credit. Also will I have to go to regular interviews at job centre.

My husband works, but he works shifts so for me to work even part time I will need to put two under preschool into nursery which we can't afford as I wouldn't be able to afford the fees.

I read that once youngest is 1 I will have to start looking for work or lose payments.

Sick with worry. Universal credit help

Morning,

I'm sorry my first post is for and not to give advice but I am worried sick at the moment. Ill try to keep it brief.

Basically my wife and I were having a few issues last year largely based around money as she was a full time student and my wage was being stretched. This resulted in us splitting. She stayed where she was in the family home with my two children and I moved out into a little apartment. I get paid into my own acc but still pay money into the joint acc as well its still my house and my children are there. I'm up there often, they are my children after all...

She started claiming UC pretty much straight away as she has no income and an increased bursary (student nurse) all of which was declared with various people and they confirmed she was entitled to it. 6 months down the line she goes on a girly holiday to Majorca, stuff happened with someone (nothing intimate more a connection) and it made her guilty...to the point where she says she thinks we rushed the separation and maybe we should give it a go.

Excellent I thought...

However now im panicking that she's falsely claimed (I haven't claimed anything). From what im reading we should split permanently however this was always the case until recently. I am a worrier so I am now worried about the future of my children etc...its making me sick to be honest.

Did she falsely claim?

Thank You.

Universal Credit Help

Hi Guys,

I am really confused about what application or how my husband and i should go about applying for universal credits.

Our Situation:

I am currently 32 weeks pregnant and currently living with my parents because when i lost my job we could not afford for my husband and i to live together as he was only just making enough money to cover the bills. Another reason for moving in with my parents is because their home is 2 hours closer to my university and i have exams this week and next week i need to attend. I am not a full time student and am not getting anything from Student Finance England. I have not been attending lectures at all for a year because i had completed all lectures and course work last year but had to defer my exams due to my poor health and being unable to complete my final year exams last year.

When talking to universal credits a number of times my husband was originally advised to claim as a couple despite the fact i am currently not living in the house with him as he still has a financial responsibility for me. As we where applying as a couple we ran across a problem, for some reason the online Identification thing doesn't work for either of us, it doesn't recognize any of our bank cards or past addresses which is very weird as we have been on the electrol register and paid bills at all past addresses. Our bank cards have all at one stage also been registered at thoughts addresses as well. And lately i have been struggling to drive over an hour because i want to fall asleep and get server stomach pain and are very uncomfortable driving in the car. The home i rent with my husband is a 4 hour drive from my parents home. As a result i went to my parents local job centre and asked them if it is possible for me to verify my identity here and could they inform the local council for the area we are renting.

I was then told i need to actually apply as a single living with my mum and then my husband has to tell his local council he is already receiving benefits so the application goes quicker. As you can see i am now very confused and unsure what to do.

I am planning to move back into the rental home with my husband once i am finished with my exams and the baby is born. Sadly i cant move in earlier because we rent a home owned ( But not lived in ) by his parents and they are planing to rip up all the floor boards in the house and do a complete refurbish. Even my husband has to move out and into their home for that time being. We have asked but they will refuse to give us rental reduction during this time and i'm kinda worried it wont be done before the baby is born as they haven't even started yet. And we cant as a family move in with his parents because the house is too small ( 2 bed home) and his brother still lives with his parents so both me , my husband and the baby would have to share a small room with his older brother.

I have discussed moving out that home and having us all as a family stay with my parents however my parents have a rather poor opinion of my husband and he isnt comfortable with this. As well as the fact we have two cats which my mother is highly allergic too, we would have to sell/ or giving to a rescue ( Currently on a waiting list) them to be able to move anyway. Which we are doing regardless to whether we move out or not because of our current financial state. My husband is also rather reluctant to move and truthfully so am i because his parents charge us £400 for rental in a three bed house which is amazing and we can hardly afford that. Very scared of the prospect of having to look else where as we can already barely afford such a cheap rental and we both don't want to live with my parents forever.

My husband was a Career but recently left his job because he had to take a month sick leave due to the job being inflammatory to his mental health. He was on a guaranteed hour contract of 23 hours and made £750 a month. He became paranoid and was struggling with quite sever anxiety and depression. He is now on on a zero hour contract with Mc donalds. He is really enjoying the job and his mental health is improving but he is making on average £150 a week.

I am currently working on and off in my mothers hair salon. I make about £80 a week if im working. Currently not working as my mum wants me to study for my exams which i am taking over the next two weeks.

My husband and i are both 22 years old.

Any advice or help would be greatly appreciated i am super stressed right now and tired of having to borrow money from my parents.

ESA and wrag question?

$

Hi folks,

I wonder if someone could answer this please.

if I am put into ESA wrag (contribution based) without a face to face which has happened to be before, and then ask for a MR as I am currently in support group, can they then reduce the wrag group to no award at all, even though I had no face to face this time around.

I do realise that in most cases it will be a face to face, but just want to know my options.

Many thanks to all once again for your valuable help

Declaring work while receiving ESA

Hi,

Apologies for diving in with a request for advice...

I'm currently receiving income-based ESA after a breakdown earlier this year. I'm signed off work, but a short opportunity for a couple of days' freelance work has come up which I think I can cope with.

Under normal circumstances I'd invoice half up front and half when the writing project is complete, but I'm wondering how best to structure my declaration to the DWP - I want to ensure I follow the rules as much as possible. Both halves will take me over the threshold for earnings, and I'm fine with losing benefit for the period that I declare. The question is, though, what do I declare and when do I declare it.

Do I declare the work as I do it (in one block of 2-3 days), or the income as I receive it (in 2 tranches as it's paid)?

Thanks in advance.

Advice with bedridden wife and what path to take

$

Hello,

My wife has been diagnosed with systemic sclerosis and is bedridden around 75% of the time. I am currently in receipt of ESA IR for long term health problems, my wife is on this claim as my partner. Given the difficulties my wife faces she requires daily help with everything, she can barely walk and is extremely poorly. Should she have her own ESA claim or PIP claim?. I am utterly confused by the various processes and what is and is not permitted when it comes to applying for one form of assistance or another. If someone could perhaps clear up what would be the best move for my wife, it would be greatly appreciated. The mounting costs of endless hospital visits out of town have finally left us to where we need to seek assistance.

Thank you for taking the time to read.

Claiming mileage

I used to do this in the past but not done if for many years. I understand it's still possible to claim back mileage expenses up to the rate of 45p from HMRC. Is this done annually and I can't remember if it's refunded in the form of a cheque or your tax code is amended. Also is this possible if a car is available it you choose to use your own or if the company pays a small contribution.

ESA, capital, and owning one's home

My ex has an asset that she wants to swap for a house I own of equivalent market value. She would then be able to claim full ESA because her remaining capital would be under the limit.

Suits me too, but what could possibly go wrong?
