Here is the situation in brief.
I took on a two bedroom flat March this year as a private tenant.
Since then I have applied for LHA and I have been told it has been accepted but still waiting for payment.
I was previously on JSA but due to a torn ligament I was told I'm unfit for work and had to claim ESA.
The last ESA payment I received was on the 2/05/13 and I haven't received anything since.
On contacting the DWP I was told that the case was with a decision maker as they have found out that I have an income of £98 a week from my lodger.
The two bedroom flat costs £850 a month. I am the main tenant and there is a sub tenant paying £425 a month. (the landlord is aware of the sub tenant)
It seems that now I have applied for LHA the DWP have stopped my ESA.
How can they claim this as "income" if it is going straight out again to the landlord?
How can I fix this situation?
If I move to JSA will it be the same?
Thank you in advance for all your help!
