partner dismissed (diputing!) - what benefits to claim?

Hi all,

After a bit of advice as I'm out of touch with the benefit system.

Basically my partner was previously working full time, and recently became ill with work-related stress and put on medication. He kept his workplace informed and handed in sicknotes as they requested. He has been off a little over 2 weeks and yesterday received a letter saying that he had been on "unauthorised absence for 10 working days therefore they accept his resignation, as per his employee handbook". This is a load of rubbish as he has handed in all his sicknotes, and we plan to fight it as they've treated him badly since employing him. They also never paid him sick pay and "let him go" without paying owed holiday meaning we've had no wages for 3 weeks.

That issue aside, we're now in the position where we need to either quickly find another job (and we've both been looking seriously for quite a while now with no success) and have zero money in the interim, or to sign on JSA and start a claim.

I've read in several places about sanctions and I'm worried that if he (or I) apply for a joint claim we will have one, and what we would be able to do then to make up the money (I read about hardship grants but have never had any luck with grants in the past). I am also aware that we are no longer entitled to the Working Tax credits we get - unless we move quickly into self-employment. Again, I have read about a roll-on but can't find any recent info - any ideas on that front?

So basically I'm thinking the best route at the moment is to submit a claim for JSA in my name, and look for full-time work. Only thing is we have two small children (4 and 2) and I am currently studying part time (20hrs) a week for a degree with the Open Uni, so really I would be happier working part-time with my partner doing the same, until he could get a full time job and we could afford the childcare.

Any thoughts or advice on our situation? I'm not trying to be sneaky or whatever, I'm just genuinely lost and extremely worried as we have no savings, and we don't know what to do for the best. We're very fortunate his family have been able to cover this months rent but there's no spare cash from any avenues to help after this month.

We plan to speak to ACAS and CAB regarding his unfair dismissal. To be honest he wasn't happy there anyway hence his breakdown, but them lying and sacking him unfairly has now meant we have had no income for 3 weeks and we're all in a right state of worry. And although he was seeming better he's now back in the dumps again and I'm so angry they've caused all this.
