Income Support Question

My husband walked out on me and our 3 children (7, 6 & 5 months) last week leaving me with no money. We have been married 8 years and this is not the first time he has done this. I never want to take him back again as he has had so many chances and now I have to put the children first.

I've made a claim for Income Support and informed CSA as he is working in the UK, but I have the feeling he may leave the country and return back to his non EU country of origin in order not to financially support his children.

After we married, he was gifted a house in his sole name from my now estranged father. The house is in the non EU country (not the UK). I have no rights to insist he sells the house nor do I receive any income from it - it is not occupied. As we are married and I have had problems with him before, I did get a family injunction (from the non EU Court) placed on the house which prevents him from selling it without my permission or taking loans against it in the non EU country.

If we do get divorced, under recent laws in the non EU Country, I may be entitled to half of the proceeds of any sale.

My solicitor has told me that as the property is in my husband's name I do not have to declare it for Income Support purposes. Also my husband is not entitled to Legal Aid due to him owning the house abroad.

When I made my Income Support claim over the phone, I was asked if I owned property abroad, which I replied 'no'. They did not ask if I had any interest in a property abroad.

Is what I've been told correct, as I dont want to get myself into any trouble?
