Was wondering if anyone can advise, we are appealing DWP decision not renew our daughter DLA, she was on middle rate care due to deafness,

At the first hearing in May, which was adjourned, the judge directed that
The Respondent (DWP) is to lodge within 28 days the previous DLA claim pack, decision and any medical evidence upon which that DLA decision was reached and provide a supplementary submission which addresses the point made in UKUT decision YMvSSWP (PIP)[2018]

At this time we have not had anything from DWP and when I rang the clerk, they reported that DWP had not submitted the supplementary submission,

What does this mean? We have a new hearing date in around 3 weeks.

CTC Overpayment of £4761: HMRC informed; should we dispute?

Hi,
So our earnings for 16/17 were £25k as for 5 years before. 4 kids so CTC was £170 per week.

01/09/17 my wife went full time again and informed HMRC. She updated hours from 30 to 37, not estimated earnings. No change in weekly CTC amount received.

I was waiting on an old pension scheme to cash in so I ran a CTC calculation for 18/19: we'd still receive £22 per week.

When my pension lump sum settled in Feb 18 I informed HMRC.. CTC all but stopped (understandably).

My wife's earnings submitted in P60 for final 17/18 settlement of CTC and 18/19 calculation; her figure was £29500.

To our shock CTC wrote to us to say we owed them £4761 overpayment. Given we ran CTC calculation for 18/19 and were correct, we will receive £22 per week AND we informed CTC of my wife's increased hours should we dispute on the grounds CTC did not adjust down our 17/18 payments mid year? I've had conflicting advice with some advice and benefits people saying an appeal could very likely be successful as HMRC did not abide by its responsibilities, but others saying "buddy, you earned too much, they can ask for it back" :0

Any advice / experiences of this gratefully received.

In short, we could not have reasonably known an overpayment was occuring. Thankfully with earrings of over £20k per annum in 18/19 (triggering a 50% clawback) £3300 of the total overpayment will be paid off out of future CTC awards by then end of 19/20, but is this not a moot point if weve been treated unfairly re: the overpayment, given we've lived up to all our responsibilities?

Solar FIT income and ESA

I have solar panels which generate less than £20 income a week. When i had the system installed 5 years ago I believed that income of under £20 was disregarded for Employment Support Allowance purposes. I phoned to check last year and have gone through 13 months of hell (whilst seriously il)l, mandatory reconsiderations, several demands for all the income back and numerous mistakes and cover ups from DWP.
The best arguement they came back with was, you're not employed so we wont disregard the first £20.
My arguement is, when i had boarders i wasnt employed either, I provided a room, for which they paid rent regularly but ESA disregarded the first £20+. They also disregard allowable expenses i believe.
Now, I paid for solar panels, I generate electricity, which i sell to the utility co whom i have a contract with and they pay me regularly for the service. The income ive had only covers the £4,300 i paid for installing it. Unfortunately it broke down at xmas and i cant afford to fix it.
They are trying to say it has more in common with income fom an investment such as stocks and shares which to me is a selfish investment and benefits noone but the account holder....as opposed to working, renting a room or selling electricity to the grid, (which is putting something back into society) and the first 2 of which disregard the first £20!
I need to take this to a tribunal but dont have any legal precedents or caselaw to back it up. Citizens advice, Welfare rights and the local advocacy charity say they dont want to deal with it and the only 2 law firms within 20 miles wont either. I have sevious health problems and desperately neen help with this. Is there anyone out there who can help or point me in the right direction?

Universal credit advanced payment question

Hi


Probably a daft question, but if I were to request an advanced payment on universal credit, how much would I get? I mean like would it only start subtracting a certain amount as part of a repayment plan or would it just completely take the amount off that you borrowed when you get paid? :) hopefully made a bit of sense, totally new to this so its rather confusing :)

Im stuck and dont know what to do i want to rent a house/flat privately but cant afford one so would need to apply for housing benefit but my area (N London) has universal credit so would i need to apply for that instead?
Also i get PIP and ESA would i be entitled to HB or UC?

Would i need to find a house first and then apply for it or can i do it before? Im single and over 35 so would only need a 1 bedroom, i dont want to get a house/flat first and then apply for it and they reject my application for it and im stuck paying full rent as i cant afford it..

If my ESA (CB) is totally stopped after work capability assessment, and I ask for MR, if that goes against me, do I need to get fit notes from GP until such time as Tribunal makes a decision?

Working Tax and Universal Credits HELP!!!

Hi
Long story short had own business was claiming WTC and CTC as a single parent business closed so I claimed UC on 9th July and my WTC and CTC was closed by DWP but now Ive got a job I start on monday and am due UC payment on 9th August BUT Ive explained I cant get to my work commitment meeting as I now have a job 8.30am till 5pm Monday to Friday and unless they could see me Weds/Thurs or Friday this week that my new working hours makes it impossible there attitude was we cant see you for 2 weeks anyway and if you dont come you dont get paid is it possible for me to reinstinate my WTC and CTC claim as a rapid reclaim as theres no way I can miss anytime off work as the first 8 weeks is training and if any time missed then the job is gone so I am in a no win situation with the UC scenario. I suspect its just a way to get out of paying me anything but I am not willing to lose a job because some idiot at DWP cant use common sense. Any advice would be greatly appreciated I live in a full UC area as well...thank you in advance

Hi, just got a quick question about the ending of my Personal Independance Payments..

I suffered with psychosis/schizophrenia for a while and my carer suggested I get on PIP until I get my feet back on the ground, I recently got sent a form to re-evaluate my payments but I think I am capable to go out and start working now, big thanks to the early intervention team for that.

I won't be getting back to them to renew my claim, but they have said the payments will end on August 8th, I was wondering if I will be paid any money for the time leading up to August 8th, and when that will be.

Tax Credit Renewal

I did my declaration and tax credit renewal online and received the confirmation etc but have not heard anymore since.

The website says it is being dealt with this should be completed by 19th July but this is just the standard 8 weeks from the day I renewed. Usually by now I have had final statement for last year and provisional award for this year.

Are they just running late or should I contact them? Still getting payments and had no correspondence by post since my renewal notice.

Hope somebody can help out here!


I have a neighbour who is going through a seperation from her husband (he is leaving). She is Spanish, lived in the UK for 8 years and has a 3 year old British child, fathered by her British husband.



She is unsure if she will be able to claim income support as she has worked very little as she was supported mainly by her husband, she is afraid she will have to leave her home (council).


If anybody can advise of any support she may be entitled to I/she would be most gratefull, thank you

State Pension

My wife is 63 she is receiving ESA (support group). An occupational pension, I am getting Carers allowance.
I am 65 shortly and have been advised of how much state pension I will receive and when. They have advised me that carers allowance will automatically stop. Which I knew.
My question is, does my wife have to advise DWP of my forthcoming pension or will they be aware, as we don’t know if it affects her ESA as she gets an allowance for a partner.
She seems to think that the system will be aware because of NI numbers, they are so hard to get hold of so don’t want to waste time telling them something they should already know. Thanks

Limited capability for work

Hey guys, I hope everyone is doing well today.

Im sure this has been talked about but i feel better asking myself.


So i had a health assessment a while back now and i got put in the limited capability support group. I think i scored 18 points. I feel i got put in the wrong group as im homebound with agoraphobia for around a year now.


I need to know if you need extra points (How many) to be put in the work and work related activity group and if you dont score enough points do they make any exceptions to your situations like life traumatic events like childhood abuse..


I was extremely embarrassed and scared to mention my events as i had someone that was going to explain for me who knows me really well.


Anyway i have mentioned all these things now in my mandatory reconsideration letter with evidence to back some of it up. Obviously not my abuse but other things i failed to mention.

One point short of daily care in PIP.

Hi folks,

I have just been told over the phone that I qualify for standard compnent of mobility in PIP (managed migration from DLA) but it seems I am one point short for daily living so it has been disallowed. Seemingly I only scored seven

Letter is on its way and no doubt things will be clearer when I get it, I am also getting assessors report.

I think I will have to go down the road of MR and maybe a trbunal though there is a chance I could loose the lot (mobility component)

I am registered partially sighted (have official proof) and even the assessor said that if you have poor eyesight it tends to affect everything in your life, was very pleasnt though, so very possible that its a decision makers decision to disallow the care compnent.

I use aids such as bumpons on the cooker on/off knobs, have magnifiers prescribed from the low vision clinic, and have one hearing aid from the local hospital. I thought those aids would have counted as 5-6 points on its own, leaving aside the other psychological and health problems i have.

I do have a GPs letter but that is from 5 years ago, so dont think I can bother them again, as they will only put on whats already on letter I sent in.

So I can't really send any more evidence.
So i take it, a MR is my only chance to get care decision reviewed and maybe then the tribunal if it doesn't work?
Though I realise I could loose the mobility component as well.

Claim for housing benefit refused

Hello , i have recently had a heart attack. I am receiving E.S.A. I am unable to work at this present time. I submitted a claim for housing benefit online which said i may be entitled. It needed more information i am renting a property from my local council. But i purchased a house last year which i have been renovating with the intentions of moving in which was before i had my heart attack. The council have refused our eligibility for housing benefit stating that the house i own is classed as capital. There is no mortgage on the house i paid cash. I am not working with less than £6,000 in savings so the council expect me to live off my esa which is £73.00 per week and my savings. Maybe they want me to sell my house so i can use that to live off. Is this what this countries come to? Ive worked all my life and paid my taxes. I am not renting my house out so it is not generating an income :mad:and i am paying council tax on it as well as on my rented flat. I am a bit disgusted in the outcome. Does anyone have any suggestions as to what i can do? Hopefully my health will improve then we can move which will save money.

Nhs prescription penalty charge

Hi

I have purchased NHS prescription prepayment certificates for years. I buy them every 3 months.

This year between March and April there was a gap and I forgot to renew so for a few weeks I wasn't covered when I thought I was. I'm a fool I know !! During that period I collected about 5 different precriptions on different dates (a few of my prescriptions are on a need-only basis and not regular medication).

Last month I received a penalty notice which I fully accepted was my fault and paid. No excuses. Prescription cost + £44 penalty charge.

However, today I've received another penalty notice for another precription I collected during the same period when I wasn't covered. Prescription cost + £44 penalty charge again.

Looking at the NHSBSA website it states:

"If you are sent a Penalty Charge Notice you will be asked to pay the original NHS prescription or dental treatment charges, and an additional penalty charge. The penalty charge is five times the original amount owed, up to a maximum of £100"

Of course I accept I need to pay the original precription costs but by sending me out individual notices with a penalty charge per notice doesn't seem right? Surely, I should just receive 1 penalty charge for the one period I wasn't covered even if it's the max at £100, not multiple penalties per prescription of £44 which could potentially far exceed the stated max of £100?

Does anyone know the rules? Have they made a mistake?

Maternity grant

My current partner she is expecting her first baby which is due this month. She applied and filled in forms for maternity grant and we had a letter through post other day saying they have made a decision that she isn't entitled the sure start maternity grant. There decision they have based it on is that because I also have a daughter from a previous marriage who I have joint custody of and lives with us few days a week. So can they legally do this because I take care of my daughter's welfare and her mum.

Disability Car benefits

I'm trying to find out if my mum can have a disabled car. My step-father who doesn't live with her but cares for her needs an adaptive car as he's 81 and struggling. Mum is on attendance allowance, wheelchair bound and shes 71. I'm going round in circles trying to find out if she could be eligible to join the motability scheme for example as they only talk about DLA and PIP which are not relevant to her. Anyone have any advice please? thank you
