If ATOS overbooks your WCA

ATOS overbooks and tells people to go home. If this happens to you, don't leave without some sort of headed paper/appointment card which shows that you did attend and confirms that you have been told to go home without a WCA.

Or you may find your claim being closed for Failing To Attend. And if it is closed for FTA, you will have your evidence.

Shocking but true and all too frequent.

Hi, long story so please stick with me. I think I have read everything I need to, so I'm really just looking for advice and tips.

Last February my wife and I moved back to UK from Australia as I was diagnosed with cancer for a second time. We had been due to move to Canada but had to stall.

I was put in the IB ESA SG apparently in July 2012, for one year. My benefit went down to zero just NI contributions as my wife actually got a job.

However, she went left her job due to maternity, and obviously hasn't gone back yet as our son was born in November.

My treatment ended in August last year (well, not including time for recovery from surgery).

We have been on income support since November as that benefit was worth more than IB ESA. That will run out on 07 March 2013.

To add extra complication, we had set up for us to go to Canada this month, but in late January I was diagnosed with metastatic cancer again (amongst other things).

Anyway, I got a second opinion from my surgical team and the Royal Marsden hospital who had done all my previous treatment, and they actually said they coundn't find anything and there was no need for treatment - and yes, I do believe them (another long story).

In this time, I had blown off the job in Canada, and committed to staying in UK until I'd been better for at least a couple of years (we just wanted to have a home and stop being in limbo!).

So, the point is when our income support claim ends on 07 March, I assume that I will have to go on JSA as technically I don't qualify for ESA as I've got better - even though I was placed in the SG for 1 year last July. Is this correct?

Can anyone give any advice about transitioning between ESA and JSA? We've also rented a flat and will be claiming HB.

Part of me just wants to run off to Canada but I feel I've mucked the company around too much and have formally not accepted their offer. Not to mention that we are in a rental contract here, and my hospital want me to have followup scans - but Canada has been a dream for over a decade.

Today I had a letter from the Tribunal regarding my appeal but I'm really unsure what it means. Could anyone shed some light for me.

Decision. Notice

1. The appeal is allowed

2. The decision made on 03/01/2012 is set aside

3. Mrs xxxxx is entitled to employment and support allowance with the work related component

4. This is because insufficient points were scored to meet the threshold for the work capability assessment but regulation 29 of the esa regulations 2008 applied

5. No schedule 3 descriptor applied

6. The tribunal recommends that the department reassesses the appellant within 3 months of this decision.

Cogent documentary evidence (from a gp) was supplied at the appeal stage


Any help with this would be gratefully received. Thanks

Hi, I had an accident at work last October, I am struggling meet my mortgage payment and daily bills, I just found ut I can tt claim industrial injuries benefit, I rang dhss and they said I am not entitled to any help. I would be better off if I signed on the dole which I do not want to do!

I am wondering can anyone give me any advice as to regarding benefits please?

Really, what on earth is it?

First of all I received a letter last Friday, it said I'm apparently now on Skills Conditionality scheme, it also said I've received a letter about it before which I haven't, honestly it made no sense at all.

I phoned up the JCP and repeatedly asked them if they could tell me what it's about, both people I spoke to just said I'd need to speak to my adviser, problem is I haven't seen him since just before Christmas, there was a lot of that heavy snow and he didn't come in then (even though I walked there still), after the near month another appointment was made and on the day I was told he wasn't in and that was it, an appointment was made yet again for 2 weeks later, and only on the day I was supposed to see him again did they tell me they booked an appointment with the wrong adviser and would make a new one so I should just sign on as normal. After that on the same day yet again I was told he broke his foot that very day (coincidence?) and so I'm now meant to hopefully see him again next week.

I've found nothing really what it's meant to be about anywhere, except for a lot of programmed and pasted things that I don't understand.

Does anyone know what Skills Conditionality is?
I know it said on the letter something about it's to do with missing skills I need for work I have no idea what they even mean ANSI think I'd know if I was missing anything myself.
Also does anybody know if it would be set in my local area, or am I going to have to somewhere near Bermuda triangle for whatever this is?

One last quick note, what should I do if want to change my adviser to someone else? I know 9/10 of advisers are a bit arrogant, but I'd still like to go see one when I'm supposed to and I haven't seen my current adviser for well over two months now.

Hello every one thought i would like to let every know of my experiences with the DWP my husband an i were on contribution esa i have been disabled for 30 years, and my husband some 9 years with mental health problems, last year when his contribution esa was to end we had no telephone call or letter from dwp (which they are supposed to do six weeks before entitlement ends) we belived we would have to fill in a form for income based esa i my self 365 days runs out in May this year, any how no phone call, so i phoned to ask for income form, filled it in, if i hadnt of we would have had no monies for christmas, i did all the chasing, being on contribution we were both getting £96 per week, paying our council tax and prescriptions,to my horror our new benefit is £139.40 per week as a couple.We have lost over £50 per week, i thought this goverment were not going to give us less money,I complained to the PM who sent my letter on to the ministers at SW1 London,who after 5 weeks sent me a reply, saying that i should have been contacted before my contribution esa ends, gave me telephone numbers for the tribunal services which may i add no one can get hold of, and the local private number of my DWP,i then got a letter from my local office to say my esa as ended as from today, as they had made a mistake, it doest matter as the rates are still the same for a couple, this whole system stinks,my esa should have ended in May this year.Its well over a year since i filled in my esa50 form, being disabled and unable to walk far, they put me in the wrag,i have appealed well over 9 months ago and still no reply, last week another esa50, filled it in again and posted recorded delivery back to Atos, they again will put me in the wrag, and i will appeal again, making 2 appeals for the same thing to go into the support group,this is why the goverment is wasteing monies the whole system is a sham.We now get free council tax and free prescriptions, but we are now worse off, we were better before, i know this is the same for many people,but some thing has got to be done? we are now in fuel poverty and really struggleing to make ends meet, but i will fight to the bitter end, my husband last week wanted to give up on his life, its a good job i am the strong one.I appealed for him to go in to the support group but guess what Yes you are all correct in the wrag, they sent us all the papers to go to the Tribunal but my husband cant take the pressure, he would have to be there.Last time when he went to the tribunal when he was on incapacity benefit he won his case big time the Judge said that he shouldnt be hear. I will end now as it sounds like i am going on but i just want every one to fight for our rights as humons, THIS GOVERMENT WILL NOT WIN:cool: Ps SORRY FOR ANY SPELLING MISTAKES.So every one please please lobby the ministers in London SW1 IF YOU WANT THE EMAIL LET ME KNOW.

oh got made redundant in december 2012, jsa cb got awarded from day after.
everything been going ok despite a few late payments, he has to privdoe my wage slips everymonth. not sure why ?
anyhow, he received a letter today saying because of a change in money coming in then he is no longer entitled to jsa cb or anything for that matter.
this can be because of 2 things...
a) my wage for january was £750 (my normal wage is around £550) however i always thought he could claim jsa cb no matter what my earnings were.
b) my husband has just became carer for our son , he doesnt receive any payments, only an underlying entitlement,( i was carer for my son but no longer meet the criteria ) however when i rang jobcentre they said i am still on their system as receiving carers allowance untill april (this still means that they are thinking im getting a rate of £58 a week - im not, but if i was it still shouldnt affect husbands claim)

i rang jobcentre and got through to switchboard, guy there said he doesnt know whats going on and will forward to correct people to ring us tomorrow.....

can anyone please advise on any of this

Hello,
Last week I attended a meeting with my Personal Advisor, having been placed on ESA in WRAG last year, transfered from IB, have ME, Fybromyalgia, other stuff, plus history of anxiety & depression, very limited mobility and capacity. All going along OK forward looking about ways forward etc etc - then the gut wrenching body blow - "Oh and you do realise that your ESA will stop in April" - WHAT !!! Told only payable for 365 days and then stops; panic attack follows; my carer called in to support me; told that I am going to have benefit stopped and because my husband has a job I will be entitled to absolutely nothing.
So no independance, no value, no worth.


I am not a scrounger or benefit cheat - I worked from the age of 16 and most recently was a Senior Manager with a responsible job - until I became ill - now it seems I am a non person, not entitled to anything - except kicking into the gutter.

I have already had the low rate care DLA taken away and mobility down-graded to low rate because of a change in DLA rules last year. Now this. The Personal Advisor said my only option was to write to my MP.

Is this really true ? Are there any options ? Anyone got any suggestions. Please.

Can anyone tell me what this is. I am getting Esa at moment but have been offered a little job (not sure if I will be able to do it or not) working for 5 hours every other Saturday. When I rang Dwp they said I could do permitted to work without it affecting my esa but not sure this correct or not. Anybody any idea

Needing Advice: Seperation with 4yo DD

I'm hoping someone here can help me where to turn.
Current living situation is this: Living in a Mortgaged property with my (now ex) partner and our 4 year old DD. Things went belly up, and we've nnow seperated. Luckily it's a 4 bed house, and we're in seperate rooms, but as you can imagine it's difficult and very awkward to live in.
He's in the emergency services, and i had to quit my part time job in a nursery to be there for out DD going to nursery, as i had nobody else to take her and pick her up. So now I'm unemployed. To help in this situation and finances for the house, i very fortunately had my parents step in and they give me a set weekly amount of cash to keep going (and keep the roof over DDs head).
Now it's come down to it, he's keeping the house, and i'm looking to leave, hopefully to rent- but i dont know where I stand with this.
I have an income, but it's not from employment. So yes, I am unemployed. I don't currently claim any benefits whatsoever, and only recieve the £20.30/wk which was Family Allowance (I forget what it's called now- Child something!)

What's the best thing to do first- find somewhere to rent and then apply for tax credit help?
I'm struggling to even find a place due to being "unemployed"- the letting agents are refusing me. my search area for housing is fairly small, as ideally i want to keep DD at the same nursery, and we already have her school application in for the coming september. she's a sensitive kid, and i don't want to disrupt her life more than i have to.

Please can someone help shed some light on this situation, i feel lost and don't know what to do first.:(

in a nutshell,my partner went onto SSP last wednesday but he's just not going to be well enough to ever go back to work as his meds aren't working and hes getting worse each day
The benefits agency explained yesterday that as long as he had a sick note from his doctors then he could resign from his job on medical grounds and he could go on to claim ESA....BUT you can only claim for ESA for yourself and i'm not entitled to any benefits as i'm fit for work

its soooo confusing and scary as i'm having to deal with it all myself and i'm confused by all the info...can anyone give me some advice please?i'd really appreciate it

I am in desperate in need of a quick answer or advice.

ive started working yesterday and was aBout to sign off jsa, joint claim.
my husband is still looking for work though.

As far as i am concern, once i start working..jsa joint claim, housing
benefit and council tax benefit will stop.


i am earning min wage at 35 hours a week and with these wages, there's no way we can support ourselves. however, ive been told i am eligible for job grant of £100, one time off and tax credit. How much is this tax credit?

Also, ive been told housing benefit and council tax benefit would run for another 4 weeks once i start working. True?

Correct me if i am wrong, should i reduce my hours to 24(joint claim), he would be still entitled to JSA and housing and council tax benefit would run as normal?

the bottom lines is that with my working hours and min wage, we would would be worst off then we were on benefit?

This it would temporary, i hope of course and once my husband is back as a bread winner, i then can continue working full time. p/s - no children.

Your advice is greatly appreciated.

Hi All

Can someone explain to me who these monkeys are from ATOS? are they the rejects that no one wanted...:D

I recently went to an assessment in Guildford and had already submitted consultants reports about my degenerative disc condition in which I am in a lot of pain most every day and am flying high on medication, if I aint flying ...Im normally crashed for long hours...
Yet I received a letter to day from the DWP who have decided from the ATOS assessment that @ Fit for work..

Cant quite understand it as bending/ lifting/ aggravates the problem along with sitting or standing for to long aggravates it also....and I am still undergoing medical treatment, spinal injections in March followed by CBT

So with this in mind what the hell am I fit for and what job out there would an employer mind me taking time off and having very few good days where I could work.

I have phoned DWP to appeal but am I wasting my time, what I found a joke was the women at DWP just told me " You'll have to get your self better for work" but Ive been like this 12 months, so if Im not entitled to ESA, I cannot certainly claim JSA as my current back issue would restrict...and my last employers ended my employment contract after 18 years cos of this back problem...

Which way to I turn now, it would seem this so called safety net that I thought was there, isnt

Hi,
My hubby and I are separating after I found out he was still having an affair. He's reluctant to move out as he doesn't want to accept it's over, and is using lack of funds as one excuse. Luckily we have a spare room... I want to work out what benefits I'm entitled to so we can figure out how much I would need from him in terms of maintenance to keep the house running. We own the house jointly and our mortgage is pretty small so I should be able to manage, but we're both on low incomes so we need to know how much we're each going to have.
I was advised to apply for income support, but have now been told that I don't qualify as my youngest child is 6. So where do I stand? I became a SAHM after he was born, although I am self-employed for a few hours a week. My income is pretty variable - I teach short courses and am paid on the completion of a course, but I only teach every other month on average and earn less than £2k a year. What help am I entitled to?

Hi,
Please could somebody help me with this problem. I'll try to present the facts as precisely as possible.
  • I have recently split up with my wife and I am currently living 100 miles away.
  • I was claiming JSA, but my GP has recently given me a sick note and today (27/2/13) I filed a claim for ESA.
  • I am suffering with mental health problems and my new GP wants me to keep an appointment with a consultant 100 miles away next week (the consultant is willing to still see me).
  • But I cannot afford the travel costs, is there anyway I can claim to get the travel costs back? It will involve a 200 mile round trip and the consultant's appointment is in a town that does not have a railway station.
I asked my Jobcentre Plus advisor but they could not help. Any advice would be very, very, welcome

hiya,

i am in a wheelchair and have some other medical issues, at present i work 5 - 7 hours a week in a school helping the kiddies with things - nothing exciting but it stops me going mental.

im thinking of setting up a little business, nothing huge just designing little keepsakes and cards.

if i do this how will it affect my housing benefit? i been researching and it seems a bit of a nightmare. as it will be a new business i will have no income only estimates.I only will be working a few hours a week.

can the council deny me any benefit? i been reading some horror stories about all benefits being cut or the council needed audited accounts?!

will the council believe im only doing a tiny business? my doctor already has given me a certificate stating i can only do 14 hours a week, can i use this as proof? if not it wouldn't be worth getting an audit accountant, the money i spend on that will destroy any profit i make?

Help needed - have reached crisis point!!
I have a long standing dispute with HMRC re; overpayment of working tax credit and child tax credit - in excess of £11,000.
HMRC say this dates back too 2003-2004. I am a single parent of 2 girls (1 at university and 1 at college). I am working as a teacher and I have worked for the same Local Authority since 2002, when I graduated. In the early days my tax credits were paid through my employer.
My personal circs have not changed in all this time. The only things that have changed are that I stopped paying childcare as my girls got older and 1 year I worked part time due to ill health. All these changes were reported to HMRC promptly. When my daughter went to University I reported this.
Normally, (although not for the last few years), teachers get a pay increase in September and I promptly reported this as well each year.

The situation now is;
I have exhausted the CAB and Welfare Rights system and I have asked for the help of my MP and an accountant. I am due to appear in Court again on 1/3/13 and my MP has been unable to secure an adjournment for me.
HMRC are messing my accountant around and will not converse with him. I have now filled in 3 authorisation forms for him to deal with it on my behalf.

My accountant seems to think that when I have reported my pay increase in September that HMRC have back dated this to the previous April. Does anyone know if this is one of the flaws of the system?

Also, if I get a CCJ against me it will affect my career. I am currently completing forms to apply for new jobs and it will be asked if I have CCJ's against me. I am also starting training to be a foster carer and it will put this in jeopardy.

The Judge at Court reduced me to tears last time I went to Court. She wouldn't allow me to speak and treated me like a criminal. There doesn't seem to be any recognition that HMRC are incapable of operating a system that is fair.

Please give me some advice. I can't believe the stress I have been put under for the last year, with bailiffs at my door and the like. I am under the hospital for depression and I take a high dose of anti-depressants. I feel really desperate now.
