My mother aged 95 has been living in home which she owns and receiving guaranteed pension credit.
She has just moved into council own sheltered accommodation. During the application process with the council she has been advised she will start to receive housing benefit.(because she receives pension credit)
However I am concerned that when she sells her house she will no longer qualify for pension credit and therefore she will also lose housing benefit and council tax relief.
My questions are:
1.Am I right to assume she will lose both these benefits because she will have too much capital?
2.Would any loss of benefits take effect immediately after the house sale?
3.On losing all these benefits she will have to pay our around £800 /month to cover all the charges for sheltered accommodation.
If we do nothing then eventually here capital will go below £10000 and I assume she will be eligible again for benefits.
Would it be acceptable to use the money from her house sale to buy a flat to obtain a rental income.We could then fund her charges with a combination of remaining capital and rental income .
Any advise or comments would be appreciated.

Can someone confirm the rules on holidays whilst claiming JSA please?
I am hiring a villa for a few weeks and have offered to fly a friend out for a couple of weeks, however, they are claiming income based JSA. I am assuming as although they can look for work whilst abroad via the web and if work became available they could fly back etc. that this wouldnt be allowed?
I am guessing they will either have to either sign off or tell porkies and claim to be camping in Wales or something?

I hope someone can help with my query…
The child tax credit people removed some of my details from the system and this resulted in an overpayment. They asked for the money back and we put in an appeal as it was their mistake. The appeal was turned down on the basis that it was our responsibility to informthem of their mistake i.e. it would have been obvious (as we are all experts in how the system works) from the confirmation letter that they had made a mistake and we should have phoned them.
The overpayment only came to light when we sent in the end of year return.
It seems like they can just absolve themselves of any responsibility here and put all the blame on us.
So, are they correct in saying that it’s our fault due to us not informing them straight away of their mistake…we didn’t know they’d made a mistake until the end of year confirmation forms went in and they said we needed to pay money back.
Is it their responsibility as, and without our knowledge or agreement, they made then change to the system that caused the error. The change was made when we contacted them regarding a totally different matter.
Or, and what we put them, that there is right and wrong on both sides so we should agree something in the middle i.e. we don’t have to pay it all back.

I am just wondering if anyone knows much about Universal Credit?
My main question is: there has been quite a lot of reports in the press, saying that Universal Credit will hit single working parents the hardest. Can someone explain why?
Having read some of the literature about UC (not much, hence why i am asking this question), it seems that everyone will be better off working. So why is it being said that single working parents will be hit the hardest?

I have been exempt from NHS prescription charges as I have been a type 1 diabetic since birth in 1954 and get my insulin and other medicines every month when I endorse the prescription form that I am exempt,. Today I came across my exemption card and with horror saw it expired in 11/2011. I telephoned the Newcastle office who issued it straightaway and they could not have been more unhelpful and really frightened me.
I explained that my mum died in 2011 when things fell apart for me and I had to move to sheltered housing where care is available 24/7 as I am now a brittle diabetic with no warnings of 'hypos'. Also I did not receive any reminder letter that they say will be sent. The card is only renewed every 5 yards so renewal hardly sticks in your mind.
They said that despite all this I would be fined or be told to pay all my prescription costs for 11/2011 - 2/2013 (when i will renew the card)
or both and they told me to contact a particular office to discuss it
adding they would be more likely to 'go easy' on me; if I contacted them rather than them finding out about it (which I now discover is 1 in 70,000). They gave me a steady list of wrong numbers which only increased my stress and worry and by the time I ascertained the correct one (nearly 3 hours later) , the office was closed and I had to make do
with leaving a message.
I kept saying that I was entitled to an exemption card in the 11/2011 - 2/2013 period as I was still diabetic taking insulnn but they kept replying that that was irrelevant - whether I was entitled to a card or not, I did not actually have one and I could therefore be forced to pay or be fined.
I am VERY worried about this. I do not want advice about how to go on from here but whether the Newcastle office was correct in what it said about the likelihood of fine/payment in view of the other things they told me which turned out to be completely wrong (different people there were contradicting each other much of the time).

I have a job interview on Wednesday, after 7 months claiming JSA then onto income based JSA.
Hours are 8am - 2pm, so 30 hours a week. It's 24 minutes walk from my home, which is great!
I went to look for the place today, and got lost, but i found it, after walking around for 1 hour.
I know it's just an interview, but there is hope.
As i have claimed jsa from july 2012 til now, will i be entitled for a gob grant and 4 weeks run on on housing and council tax benefits ?
I'm just planning ahead in case i get the job.

Hi everyone, after some advise, I have been signed off of work for quite a while due to various things. Sitting around doing nothing does not help, and ive been offered some work which i want to take, the only thing is id be classed as self employed.
And as much as i want to get off of benefits and back to work i dont want to put myself in a position where im going to be worse off. Does anyone know what is available to self employed people? (obviously until a certain wage is earned) i would like to get totally of of benefits, but if i go down the self employed route then no work means no money at all.

The other day I asked a question relating to Part Time work, self employment and WTC, thanks for your advice.
Now something hit me, what happens with Housing Benefit? When the business starts I'm obviously not going to be earning good money, and I will only be working 8 hours self-employed a week + 8 hours employed work) (read my other thread for more information: /showthread.php?p=59602429&posted=1#post59602429).
How does this work with Housing Benefit? Especially when my income will be low by the fact I'm only working limited hours?

ok so we had a new baby 4 weeks ago and filled out all the relevant paper work. i earn £11,700 a year and was gettin £10 a week working tax credit, my partner earns less than me although there seems to be a mistake on her p60 as they have her down for earning £12,500 last year which isnt right she earns more like circa 10k
we applied for a maternity grant which we were turned down for as were not on enough benefits :mad:
we recieved a letter back to say we are entitled to child benefit :T
however recieved word back today that im no longer going to recieve my working tax credit, nor are we recieving it under the new application and the child tax credit element says were getting £19.87 a month...
this seems very low from anyone else ive spoken to.. also rang back to say my partners figure is at least 3k higher than it should be and we were pretty much told that was that.. if we do a calculation on the website it comes back with a different figure altogether.. im stumped :(

Just wondering if anyone out there can help with my current situation. My child tax credits was stopped before xmas due to an ovedrpayment. From begining of Feb I have put my daughter into childcare and costing £90 a week. I rang child tax before i decided to put my daughter into a nursery, and they advised me I would receive the full 70% help towards childcosts. Our joint income is roughly £28000.
When I received my new award notice it said we would only receive £14.99 a week for child care. When I rang to confirm this was correct, they said it was, as we were not entitled to any more help due to our income.
Does anyone out there know if this is correct, as to be honest it is not worth my while doing the extra hours, for me to pay the nursery.

I am in receipt of income-based JSA as well as Housing and CT benefits.
I am renting a 2-bed privately from the time was employed. The weekly rent is £345/week. I have no capital nor any source of income till I find employment again. The Housing benefit is only £240/week, leaving with me a shortfall.
I live with my child but unable to claim any children benefits because they are already being claimed by my ex, who refuses to share any of that with me though the child lives with me. Also, my HB is assessed as a single claimant rather than lone parent for the same reason.
I cannot move to a lower rent property, as I have no capital for the initial deposit, also no landlord is interested in renting to someone on benefits and very low credit score.
With no choice left other than getting evicted from my house for non-payment of rent, I advertised the second bedroom for a sub-tenant to cover the shortfall. I have received interest from 10+ parties within a week, and can let the room out straight away.
The question though is would my JSA and HB/CT get affected by this, in which case I am back to square one. I cannot understand why that would be the case as all I am doing is renting out a room which is anyway being ignored for purposes of my HB/CT claim. On JSA, it is not really an income as I am simply covering the shortfall between my actual rent and HB.
Many thanks in advance for replies. I really need to do something soon as I have fallen in arrears on rent.
I have a number of other debts including credit cards, overdrafts, etc for which I have entered into arrangements that require me to pay almost 1/3 of my JSA- so it is really a bad situation in terms of living through the month.

Hi,
I got a letter in today about the changes to the rates in April.
After this there was also a line stating that from the 18th June rate will be £100.15 as i will reached the 365 limit. From this it sounds like they moving me onto income based automatically.
Any ideas ?

what might my dd expect to get in ctc?when the baby is born she will be getting £133 a week smp and her partner works f.t.and i would imagine take home pay around £300 a week max
in the current tax year she will have earned about £1000 a month before tax

Its about the new rates in April and has a couple of pages about PIP.
It says if you are aged 16-64 on 8th April 2013 then you will be affected by the introduction of PIP even if you get a lifetime or indefinate award of DLA.
Now I've read numerous times that those on indefinate awards will not be affected untill 2015, but if I understand the letter correctly you will be affected right away if you are between those ages, is that what it means or am I reading it wrong?

So I won my ESA appeal in January after 18 months of waiting, they paid me what they owed me last week, I was meant to get a payment from them today and haven't, so I called them and the person on the phone said it's "clerical" and that he couldn't look at claim and that someone will call me back.
Does anyone know what he means? I sent in a sicknote which I was told would run out today, I've had no letters or anything else asking for a sicknote, just them telling me they had paid what they owed into my account.
Does anyone have any ideas? I'm really fed up of being messed around by the DWP and Tribunal Services, the reason it took my appeal 18 months to be heard was partly because they had lost my file and it had to all be asked for from the DWP again... I just want a quiet life and for things to run smoothly but I always seem to get the crap, I suffer with mental problems as it is and this kind of thing just adds to it.

My 3rd bedrrom is only 37.5sq ft and a room has to be more than 50 sq ft to be classed as a bedroom yet they still claim it to be a 3rd bedroom even after i show them the westminster law

I was awarded 0 points at my Atos assessment last October (no surprise there). I sent in the form to appeal and have been told the tribunal service will be in touch with a date.
However, I finally received the report of the assessment after having to request it 3 times from the DWP. It's just full of errors and the nurse has embellished or lied about pretty much everything I've said, even putting in that I told her I was sacked from my last job which is utter nonsense!! I'm not really surprised considering all the stories you hear about Atos these days, but where do I go from here?
Should I air these concerns in a letter to the tribunal service? Or is it something that is frowned upon to say an Atos Representative is a liar? Is there a different approach that would be better to take?
Also, is it worth complaining to Atos? I spoke to the DWP and they said it's not their concern... nice! Any advice would be much appreciated, thanks :)
