Claiming Income Support Instead of ESA?

Be gentle..

Entitled to Income Support on other grounds
Some people may be getting Income Support for incapacity but also be entitled to it on another ground. For example as a carer or lone parent.

They can choose to stay on Income Support instead of going onto ESA. Or if they fail the ESA assessment they can get Income Support on the other qualifying ground. DWP say they will tell claimants when this applies to them. People who choose to stay on Income Support in this way will lose the Disability Premium if the only reason they qualify for it is through incapacity.

I currently get a IB "top up" of IS which is £50 a week, if I get rejected for ESA would I still be able to claim IS and get my IS topped up for the amount my IB was or atleast "the legal amount a person the laws says they need to live on" ?? I'm confused..

Married couple living apart but wife claiming IS?!?!

I hope someone here can clarify this as I'm sure this isn't right!
One single mum with a child has a boyfriend who lives a couple of hundred miles away, never lived together. Boyfriend isn't father of child. He works, she doesn't.
Said couple are talking of marriage in 3 months time but boyfriend is waiting to transfer to "future wife" through work. No time limit, its whenever a post comes up!
Now, they are both convinced that despite getting married in her home town, she can continue to claim benefits as a single person (although the little girl turns 5 very soon, so I suppose it'll be jsa). Their case being "we don't live together".

Surely this is incorrect, legally as well as morally?!? Won't he have a financial obligation to her as her husband?

Calculating tax credits on this years earnings not last years?

I was planning to apply for working tax credits, and I've been reading that the tax credits are based on the previous years earnings, so April 2011 - March 2012. My circumstances were completely different then and I earned more than single working threshold (15k) but that job ended 11 months ago, and I will be starting a new job soon below the threshold (12k a year). Can I get HMRC to look at my income (I will be working more than 30 hours) and base the award from now until April on earnings from April 2012 to the present?

The tax credit would be a big help. I could wait until April for them to calculate for this year, but I would lose 2 months (with backdating) which would be a massive help.

I've been trying to understand the whole thing and it's rather confusing, and some snippets of info have suggested HMRC will look at current income not the previous year if prodded but I've seen nothing definitive on that.

Cheers

work programme/sanctions

Just received a letter from DWP dated 13 Feb regarding the Work Programme.Am I correct in thinking that this is to legitimise sanctions after the Court of Appeal ruled them illegal on 12 Feb ie The Poundland Case and that any sanctions imposed before then would be deemed illegal?:money:

Holiday??????

On Sunday my partner, children and I went to his parents for lunch and his mother who picked us up as neither of us drive said that she wants to send us for a holiday she said that she will pay for it all we would just have to save some spending money. I am on Income-based JSA and I wanted to know if I am allowed to take this holiday it will still be in the UK and it will not be far from where we live as she will have to drive us there to drop us off and drive there to pick us up. I was thinking that it would be fine considering that we are not paying for it so they can't exactly say we don't give you money to pay for you to go on holiday. I will still continue my jobsearch whilst on holiday as it would be silly to not do so. Also I think one of the reasons she has offered this is because I am on a waiting list to have a major operation which involves my bowel being removed because of an inherited condition I have which the Jobcentre already know about but I still have to seek work as at the moment it doe's not effect my ability to work but once I have the operation which is unknown at the moment I will be unable to work for a while afterwards because of the recovery period etc and my partner will not be able to seek work in my place as he will have to care for me and our children whilst I am recovering. I do not know when this holiday will be I just know that his mother wants to treat us and it will probably be the only time we will ever get to go on holiday due to my condition etc. Any help on the matter would be greatly appreciated.

Waiting for operation

I am currently unemployed through no fault of my own and I have just been put on a waiting list to have my bowel removed. I am on income based JSA. I do not know when the operation will be but I am assuming that I will get some kind of notice beforehand. What I want to know is do I need to tell the jobcentre now that I have been put on the waiting list or do I need to wait until I am given a more specific date as to when I will be undergoing the operation. I have been told that because I have opted for key hole surgery I could be fully recovered within 12 weeks but if there are complications then recovery time would differ. That is all the information I have on the matter really and I really don't know what to do next. Any help would be greatly appreciated.

Company going into administration. Disability of WTC

OH is entitled to disability element of WTC but his company is probably going into administration tomorrow. This is a massive rural company so everyone in town is going to he looking for jobs. So getting a job quickly with a disability could be an issue.

Will we lose the disability element of WTC? We could just about cope with him loosing his wages temporary but losing the disability element will be really awful!!

Any advice gratefully received. We get disability, WTC, CTC benefits at the mo.

Partner's work asking for my personal details for use in universal credit system

As it says on the tin really - my partner has brought a form home from work which his employers have apparently asked all staff to fill in - the form is asking for partner's details (national insurance no) 'for use in the universal credit system'. It looks like it's just a word document that their office manager has knocked up.

I was just wondering if anyone else has had this? I find it a bit odd as I would expect something like that to be done a bit more formally, i.e. inland revenue (or whichever Govt dept) to write to us directly about it.

Part of me thinks s0d off, it's none of your business really. Maybe I am just a curmudgeon, but I don't like people asking for info that they don't really have a right to.

What do people think?

"Work Experience" Could someone please help!!

I have been looking for a job but given the current job market and quite honestly, my pretty poor CV I decided to do some work experience for a law firm. This was arranged by the job centre. I should probably add that this isn't 'mandatory' as I have only been claiming JSA for 5 weeks and I decided to do this because I thought it would help me gain some skills/experience.

You dont get paid apart from the paultry sum of 70 quid a week or whatever and it is for two months.

I had my first day the other day and they had me vacumming the floors, emptying the bins and doing the washing up. When I wasn't doing these tasks, I was photocopying hundreds of pages of documents. Getting there is a complete hassle, i can either go by bus which would take around 2 hours which the jobcentre would pay for, or get the train which means I would have to spend about 10 quid on a train ticket everyday.

Do you think it is worth doing? Or are they just having a laugh?

Please help! Thanks!

Housing Rent Advice

I have lived with my mother since October 2011, we are both on benefits, I'm 31 and she is 61, due to retire in March.

She rents the 2 bed property from a LHA, and claims housing benefit, but the housing benefit only covers so much, I have to pay £44 per months from my JSA, on top of the board money I pay my mother, and £22 off my JSA per fortnight is a lot to me.

We have contacted the LHA about it, to try and find out why I have to pay rent, even though I'm on benefits, to which they stated that I'm classed as a lodger, so the housing benefit only covers so much, which still left us confused.

I don't understand why housing benefit doesn't cover the full amount of the rent, as it's only £94 per week, and there are no empty bedrooms.

Are they correct in doing this? Any help or advice would be appreciated.

Thanks

ESA contribution or income based?

Hi
Can anyone help with a quick query
Husband on DLA and ESA (income based) as he owed approx £400 NI Contributions from some years ago.
I receive wages and tax credits of £89, he gets his DLA and £45 ESA(IB) per week.
I have come into a little cash and wondered if paying the £400 he owes in NI would make him eligble for ESA (contribution based) and if this would make us any better off weekly?
Any help would be great, if it wont make a difference I would carry on with the payment plan to pay off NIC and have a wee holiday!

paying towards council tax

How will we know whether our council intends to charge us towards our council tax will we get a letter and when?

Will it affect his benefits

My boyfriend is currently claiming a mixture of job seekers allowance and carers allowance. He cares for his disabled mother so is unable to work. At the moment he rents a room in a private house and gets his rent paid for. We are looking to move in together in the near future, I am currently earning £22000 a year and live in a house which is I am buying. If he moves in with me, will this affect his job seekers allowance and carers allowance?? We are fully aware that he wont be able to claim for his rent any more, but am not sure if I could afford to support him if he lost all his benefits.
Any info would be appreciated :o

Help with furniture for first home.

Hey everyone, I'm currently looking for some help covering the costs of furniture and standard household equipment.

For the passed few months me and my partner have both been homeless but luckily have been offered a one bed flat by our local council and are signing our tenancy tomorrow.

Unfortunately due to being homeless we have no furniture and nothing to actually sustain us in our property. I'm currently in receipt of income based job seekers allowance and will be adding my partner to my claim the day we move in. We're both looking for work and hopefully at least one of us will be in full time employment in a few months.

In the meantime however we're in desperate need of furniture and pretty much everything else in order to set ourselves up.

I'm looking for advice on any grants or loans that we may be entitled to in order to help us, if someone could point us in the right direction it would be greatly appreciated.

Also, I've looked into a community care grant but I'm unsure as to whether or not we would qualify. Considering we've been homeless for quite a few months would we come under the category of resettling after living an unsettled way of live? Or is this strictly if you've gone through an official resettlement program?

If we happen to be not eligible for a community care grant could someone give me a rough idea of our chances of being accepted for a £1500 budgeting loan?

Thanks again guys, also sorry for the long read. Ha-ha

Cheers - JamesT

Possible? Attendance Allowance.

I had a query thrown my way today asking whether it was possible for attendance allowance to still be paid to a spouse when the person it was for passed away 8 years ago. Obviously I know it shouldn't be, but it appears that the claim was never closed after his passing. The details I have are a little murky, but it appears that the person did not tell the DWP at the time - would there have been any automatic systems in place upon his death which would have alerted the DWP? (That even sounds daft as I type it!)Or would it have been down to the person dealing with his estate?

NB, The person who has done this has done it wholly in error (now has a dx of dementia), although I appreciate that this does not negate its fraudulent nature.
