In the past, I was entitled to contribution-based Incapacity Benefit, at the rate of £110.85 per week. On 5th October, I was migrated onto contribution-based Employment Support Allowance (ESA), due to a decision by the DWP to place me in the Work Related Activity Group.
The decision letter breaks down my entitlement as such:
Living Expenses £71.00
Limited Capability for Work Addition 28.15
Top-up Payment 11.70
Total £110.85
The decision letter states: 'Contribution-based Employment Support Allowance can be paid for a maximum of 365 days unless you are in the support group.'
Am I correct in assuming that on the expiry of the above period, given that my savings are under the capital limit, I will be entitled to income-related ESA? If so, will my top-up payment be affected? Will my entitlement remain at £110.85 per week?
