Recently, I completed a medical questionnaire (Form ESA50) with regard to eligibility for Employment Support Allowance. Since then I have received a decision from the DWP advising that I have been placed in the Work Related Activity Group (WRAG). The written statement of reasons states, I advise that a return to work is unlikely for at least 2 years.
Can anyone address the following questions?
Is participation in the WRAG limited to a certain period, or, theoretically, can someone remain in the group indefinitely.
Whilst in the WRAG, can the DWP make the decision that a claimant is fit for work and end their claim for ESA? If so, would the claimant have a right of appeal? Or would the claimant be reassessed by being asked to complete another medical questionnaire (Form ES50)?
