From Sept 2010- May 2012 I was not being paid for my son (16yrs old) he was still in full time education. I had filled out and send back a form informing them that he was still in full time education. I did not realize until May 2012 when I phoned up to inform them of another change of circumstances, that it was brought to my attention that I had not being paid for him since Sept 2010, I was then told that I could only be paid back for the period of April 2011-March 2012. when asked why, the reply was that's how the system works.
Can this be fair?
If I was been overpaid for that same period of time would the same principle applies? Would they just ask me to pay back a year of overpayment? Can somebody please, please tell me what can be done to reclaim the 7 months underpayment that was not paid back?
