ESA Problems.

I'll try and make this as short as poss but it is a bit of a long one, but any advice would be helpful!

My partner had his leg badly broken at work last year, 1 ton truck crushed it into a metal bar.
Anyway my partner was getting payment from his employer and Sick pay until after the 28 weeks period.
He was told by his employer to apply for Employment and Support Allowence, we did and we had a call from a lady at ESA department needing more info about the money that was coming in.
We advised that we were getting paid by his work and she said that as we were getting over £111 a week that we would not get ESA. She told us we were to ignore anything that came through, that she would not put the claim through and she would send all our paper work back to us. We didn't get anything back and did get forms for Fitness to work and didn't send these back as advised.
My partner lost his job end of December 2012 and we made a new claim as advised in January. After many phone calls, letter's and forms filled we have been told that my partner cannot claim as his previous claim was disallowed because we didn't send back the Fitness to work in November, yet we were told not to by the lady we spoke to.
We have now had no money for 3 months and we have no idea where to go from here? My partner is still signed off work and cannot walk far and his job is physical.
Any advice would be great!
