I am hoping some kind soul here will advise me. Please bear with me, I will keep this as short as possible.
I have been dating this lady for the last 6 months, she was on ESA. Single mum 2 kids living at home, 1 in school and the other in college. Anyhow, about 2 months ago, she was asked to attend an ATOS medical, where they decided she wasn't entitled to any ESA.
She suffers from both ME and POTS disease, her ex husband only pays mtce on the youngest child..
at the ATOS hearing they only chose to look at her first ME assesment which did not make clear that at the time whether she did or did not have ME. (Mainly because at the time she did not want to lose her job)
However her condition subsequently deteriorated and later assesments did indeed declare her from having ME. But as I said, ATOS ONLY looked at her first assesment. Scoring her a 0
As a result, her housing benefit has been stopped and today the housing association will be issuing her with a notice of intent to reposess
I am trying to help her as much as I can, but with a full time job, I don't have all the hours god sends, nor the finance.
My question is this, should she be present for the notice to reposess to be issued to her, or should she try and stall by not being in?
She has re-applied for ESA but it could be many weeks before she is re-assesed.
