A long time ago (2004-2006) when my ex husband and I were still together, we somehow accrued a tax credit overpayment of about £2600.
We split up soon after and I was told that the debt would be split down the middle with us each having a £1300 liability.
Fast forward a little bit and I didn't start actually paying it back until 2010, when I set up a DD, which I have been faithfully paying ever since. My ex has never paid and tells me he's going to fight (read: ignore) it. I only know that he hasn't paid because their computers spat out a 'you must pay' letter to me recently at the same time as sending one to him. I called DWP and they assured me that it was a mistake and I had nothing to worry about as I was paying.
Anyway, my question is, if they end up going down the CCJ route to chase my ex for this, will my name be brought into it, or is my debt legally separate?
