I wonder if some of you lovely people could offer some advice on a situation my brother finds himself in, he has been claiming incapacity benefit since 2003 for problems with his knee, lower back issues and lately depression, his health has spiralled over the last 2 years after putting on an enormous amount of weight, he is now the best part of 30 stone which makes all his other medical problems even worst, he receives a total of £170 a week for himself and his partner. He has his medical for the swap to ESA at the beginning of May and this morning has received the dreaded letter telling him he has failed the medical and scored no points at all, the copy of the ESA 65 01/12 that came with the letter is completely inaccurate of what happened at the assessment the doctor who saw him has either not listened to him at all or simply made most of it up!
He has just telephoned me in tears panicking about what is going to happen and what he needs to do, I have no clue but told him I knew of some wonderful people who did, hence this post ;)
He is going to appeal, I have found the GL24 form online and have printed it out, I am going to go around to see him this afternoon to help him fill it out and post it off to them, how do we word our disagreement with them? Do we describe every point we disagree with? The letter says his final payment will be on 1st July 2013, am I correct in saying as long as his appeal is accepted he will continue to be paid until the appeal is heard? How much will he get? Will he still get the top up for his partner who is also his unpaid carer? Will he need to send in sick notes? He has not sent in a sick note for years as they were no longer needed for his incapacity claim.
Could someone tell me the process of what will happen please so I can pass the information on and hopefully calm him down a bit, he works himself up something rotten at small things, this, this morning has caused complete panic.
