I'm new to the forum but been reading posts on here for awhile and listen to most of ML advice.
Anyway, until 2008 I was on JSA but was moved onto ESA due to health reasons. From 2009 I have been on Income Related ESA and I've recently won my first ESA tribunal after a appeal against an ATOS decision from mid-April 2011 and have just been placed into the W.R.A.G (used to be in the SG)
I just received an leter with my backdated payment details but the DWP have used the tax years end 5 April 2007 and 5 April 2008 to assess my claim, a time when I was claiming JSA.
This is where is gets a bit confusing
DWP says from 13 April 2012 my ESA will be £71.00 pw
BUT they have worked out it's £67.50 pw from 20 April 2012 (They have used tax years 5 April 2007 and 5 April 2008 - when was on JSA - to work out my claim for ESA)
Which we work out is £67.50 20 April 2012 x 58 weeks (Letter arrived on Sat 28 May 2013) is about (I think) £3915.00 but I received much less then half of this sum.
Now I'm not too sure if they can do this or not as I've been on Income Related ESA since 2009 and that they should/could have used Tax years 2011 and 2012 at least, so some advice would be great before I make a appeal.
Sorry to go on like this but this is the first time I have to deal with things like this.
