Morning folks..
Im looking for some help and advice if possible! My dad was claiming ESA but it stopped due to being declined after appeal.. we are now taking it to the upper tribunal due to possible errors in law.
When his ESA was stopped he was advised from welfare rights to claim JSA until he could reclaim ESA. I called and set everything up for my dad, they booked an appointment for him at his local jobcentre for him to go and sign on. I went with him as my dad suffers from social anxiety etc. When we went they were all very nice and said they would put his claim in from the date his ESA stopped. I cant remember them asking for a list of benifits he was in receipt of at that time. He hasnt been asked to fill a form in either.
He gets industrial disabilty benifit at £126 a fortnight and higher rate DLA. JSA have now sent him a letter stating they are going to fine him £50 and possible ask for money back as he never informed them that he recieves industrial disabilty benifit.
We have no way intended to mislead or lie to anyone, i think there has been a genuine mistake and we are more then willing to accept the fact that we have done something incorrectly - if we have. I will call them tomorrow as Im off work and will have more time to get it sorted.
Can anyone shed any light on this for me? If they charge him for it can they insist on him paying it right away? Im very worried as he cant afford it, im 8 months pregnant and go on maternity leave as from today so every penny counts to me. I do try and help him out money wise but i cant afford to do it all the time. Its now worrying me.
