WTC after 39 weeks maternity.

Hi,

Im due to claim WTC for the first time due to maternity leave. ( my area is not universal credit until Oct so this is normal WTC claim.)

My query is ill accrue all my holidays and bank holidays whilst im off. Im taking the full year 52 weeks.

Week 39 ends 16th September and Im due to RTW 17th Decemeber.

I know WTC stops at week 39 of maternity but does it still stop if from 1st October I use my KIT days, accrued holiday and bank holidays and was paid for them up until i return in Decemeber.

My baby was prem so i have holidays c/f from previous year too.

So I'll be on paid leave and not unpaid as im being paid for accrued holidays sooo am i classed as working or not??

Any help appreciated.
