Quote:
Deciding whether it is reasonable to grant the extension of time A4212The DM must have regard to the principle that the greater amount of time that has lapsed between the time limit for notifying the change and the date of application the more compelling should be the special circumstances on which the application is based1. The DM must take no account of the following2 1. that the applicant or any person acting for them was ignorant of or misunderstood the law applicable to their case (including the time limit for reporting changes of circumstance as set out in A4201) or 2. the fact that a UT or a court has taken a different view of the law from that which was previously understood and applied. |
So, if a claimant succeeds at appeal at a UT that it was reasonable for them to make a delayed report of changes of circumstance - this is not binding on the DWP - and they can continue to make the same decision with people in the same circumstance.
