Hello everyone, hope someone can clarify what is happening re my tribunal.
Due to have tribunal on 4.01.13 judge adjourned as the DWP had sent the wrong ESA50. They sent the one from April 11 and it should have been the one from Sept11. The judge is saying that if they proceed with this ESA 50 then the doctor who performed the medical in dec 11 and scored me 0. Had in fact used the wrong descriptors as they were amended after April 11.
I have spoken to ESA and they are very cagey whether or not they have found the Sept 11 ESA 50. I have rang the tribunal service and they inform me that although the DWP have returned some documents they are still incomplete as they do not include what the judge has asked for. Due to this reason they aren't able to list for a new hearing and have asked the judge for advice on how she wants to proceed.
Does anyone have any ideas as to what will happen now I have waited for the tribunal since jan 12 and just want it all sorted now.
