10 year old tax credit overpayment

Ok so 10 years ago back when you had to send in a renewal form to say that you had received the right amount of tax credits for the previous six months, I sent mine back 2 weeks late. I then received a £2500 overpayment because of this. I disputed it and asked for a full explanation at the time which I never received. I never heard another thing and have continued to receive tax credits until September 2015 when my salary was finally high enough to take me out of tax credits. Nothing mentioned on any tax credit paperwork about the overpayment in the last 10 years. In December I get a letter saying I have not paid the overpayment!! After 10 years. I called and was told HMRC have decided to collect all overpayments, even old ones and the Limitation Act does not apply. Can this really be true? Whats really galling is that I was entitled to that tax credit. I didnt lie about my income or circumstances i was just late handing in a form. Can anything be done?

I am worried about earning only £6000 or less in my first year and therefore wouldn't pay NI as it's too low. Would I not have any NI payments made from claiming tax credits? And if this is true would I lose out on a pension? If this is the case, wouldn't I be better off on the dole? as they pay your NI contributions!

ESA compliance interview

Hi to all

I'm desperately seeking advice about a letter I've received today about my benefits, I currently claim Employment Support Allowance (support group) and Personal Independence Payment (standard rate). Im 22 and been claiming for exactly a year due to my depression and anxiety .

But this letter I have received from the Local Service Compliance part of my local Job Centre plus has really tipped me over the edge and made me consider suicide again- I've already attempted it and nearly died, almost a year ago. The letter says:

We are reviewing your benefit claim. We've arranged a time to talk to us about any changes which could affect your benefits. It then goes on to say that attendance is compulsory, I need to bring ID and recent bank statements etc and its got me in a frenzy. At first I only claimed the standard rate of ESA but was upgraded to the support group and enhanced premium through no action on my own part, just receiving a letter which said I was getting more money. What I didn't realise though was that this part if ESA was to do with savings and I have savings of over 10k.


This has just put me into suicidal mode again. I'm worried that they're going to bankrupt or prosecute me despite not knowing it was income/savings related! I've got so much stress at the moment, my parents divorcing, dealing with obsessive thoughts, being unhappy and depressed and now this letter is the latest in a long line of stresses. That's all my life is, constant stress, a struggle all the time. After this letter for an interview in 2 weeks time, I don't really see the point of carrying on, Im just chronically unhappy. I can't sleep any more and my quality of life is about nil because this letter has really pushed me over the edge. What do I do, I just see no hope or escape from this.

Hi

My current situation is

I work 37hrs, wife works 21hrs a week.

2 children, 1 with childminder 2 1/2 days a week, the other full time primary school

My wife is considering cutting her hours to approx 10hrs a week.
So childcare hours would reduce to approx 2 half days a week, maybe a little more.

My question really, i'm trying to work out roughly what tax credits will change to, but i cant find the correct table for when both are working, but only 1 is working over 16hrs.
Can anyone advise which i should use?

Hi.
New to the forum but really need some advice as I can't seem to get any elsewhere.
In July 2014 I had a little girl. I was claiming child tax credits for my two older children. After her birth I called them up and they added her to the claim and I began to recive payments for her.
In April my payments for her stopped and then they sent me my renewal pack saying I owed them £1600. I called to ask why. They told me that in February 2015, 7 months after adding my little girl on to the claim they had written to me for more information on her. I received no letter. As they didn't hear back from me they cancelled her claim and now have it down as an overpayment as she wasn't entitled to it as I didn't supply them with the information they requested. I did dispute this.. explaining I never received the letter and that they should never have agreed to make payments for her if they needed more information/until they had all the information, never mind wait 7 months into the claim to ask for this information. They said I still owe the money.
I contacted citizens advice who told me as long as I give them the information before 31st July 15 when the tax year ends then it should be fine. So when I disputed it I asked could they let me know what the information was so I could get it to them. By the time the dispute had gone through and I heard back from them to say no I still had to pay it was October and well into the new tax year. It has now gone through to a debt collection agency.
Is there anything I can do? Or do I have to pay this back? I have a new claim now with all three of my children on...
This "over payment" was never an overpayment, nor was it any of my fault. I can't talk or get through to anyone and I still have no idea to this day what the information they requested was. All I know is that they say they fulfilled their duty of care and unless I can prove otherwise I have to pay it back.

confused and worried about customer compliance

I started claiming income support in Sept 2014. I had a letter from dwp 3 weeks ago saying that i was to have a customer compliance interview on 13th Jan. They phonecall came, was over in approx 5 mins. He asked if i had 2 accounts in Lloyds which i have so said yes and asked if i had any savings in them, which i havent. He then said something about hmrc and did i have any savings during 2013/2014 tax year and i said no again. I was completely flumoxed by his questions,my mind was all over the place as to why he was asking me. Hes asked for all my bank statements for that tax year and when ive gone onto my account to print them off it i was horrified because i forgot genuinely that i got my divorce settlement of 33k in Jan 2013. Long story short, in 2011 i left a violent marriage, the financial side.of my divorce took till the end of 2012 to sort out. In the.meantime my parents lent me the deposit for a house. I paid them back in June 2013, i didnt pay them.back as soon as i got the money as i wanted to.move but decided to stay as my son had been gravely ill in hospital at the start of the year and i couldnt cope with moving. So the money was in my account for approx 5 months before i repaid my parents. am mortified that i forgot this money being in my account at that time and now think i look like a liar. For one, dont know why they are asking for all my statements and terrified beyond belief that i have unknowingly committed some kind of fraud. Would be grateful for some advice, i didnt know if i should ring the compliance officer on Monday and tell him about the money as well as send him the statements. Have i committed a fraud of some sort? I really dont know what to do.

Under-estimated self employed figure

When submitting my last tax credit figures, I estimated my OH's figure based on last years earnings. The figure has just been finalised and it is £2,000 more than the estimate.


Does anyone have any idea what the effect will be on the payments.


The figures are:


OH - £18,005 (this was estimated as £16,000)

Hi all,
I might have the opportunity to help as a volunteer driver. Paid per mile and paid waiting time . I'm self-employed single-parent claiming working tax credit and housing benefit. I just wondered how this would affect me? Does it count as my hours as it is volunteering ? Surely if I'm putting the money for fuel and min wage for waiting time down in my yearly profits Then it goes down in my hours? Thankyou

Taking a Small Pension Lump Sum

In October last year I decided to take two small lump sums from a couple of pension plans I have running these have been inplace for many years and I have niether paid into them or taken any benefits from them until last year. I have been claiming ESA since 2010 and didn't think I need to mention these pension pots as I had no intention of touching them until I reach retirement age. I was a little short of cash and as these small sums (under £3K )were available I decided to take them. I called HMRC as well as DWP and asked if the sum would affect any benefits I receive and was told definately not. Before Christmas I received a letter asking for proof of the lump sums I hav e taken, which I duly sent off. Today I received a letter FEPSL7 asking for any investments.or capital my wife & I may have. Or if I have spent the lump sum I must provide reciepts. If I do not provide this info my benefits may be stopped. Now I have spent quite a bit on Christmas Presents for my Grandchildren and being a double amoutee I spent most of the money online through Paypal & Amazon UK I can provide the evidence of the transactions but no reciepts. What I would like to know is (A) If this evidence is admissable & (B) What savings are we allowed to have, we have no capital or investments only my MOD Pension & a private pension which I do not intend to touch for another few years. This has got me really worried as I feel that I have done everything right and that I am being treated like a Benefit Fraud. Thank You in advance for you help

I wonder if you could help please. My daughter who is a student and on very very low income had a filling and checkup etc and it cost her £50. Last year I helped her fill a form in (can't remember which one now sorry) so she could claim it back. However she allowed it to expire.

She filled in a HC5 form and they have wrote back stating that as she did not have a valid certificate at time of treatment she isn't eligible.

Is that right?

Stopped tax credits, new claim is with compliance

Hi, I'm kinda new at this so forgive me if I get it wrong...

Basically long and short of it is hubby and I split beginning of year, I claimed as single person then, then beginning of April to beginning of June we got back together but I didn't change to couple as I honestly wasn't sure it was working out, anyway he moved out got his own place. Unfortunately mid/end July our son nearly died so it brought us together and we spent 6 weeks in hospital with him, around about sept he moved back in and again we see how things went, yet again like a prat (and in the many hospital appoinmments) I didn't change any detail...fearing it might not work again, then October we moved hoping move would be fresh start yada yada, so in the chaos of this and cleaning the other property out etc, getting phone sorted etc, i didn't update details till December....my fault entirely in the chaos of my son nearly dying, moving etc I should have found time.

So I got a letter from HMR and I called them straight away and the stopped my tax credits immidiately that was 9th December and told me to put a new joint claim in.

Joint claim sent 16th Dec, they received letter 24th December.....

I've had a final award notice for single claim up until 1st September when I said we'd started living together again. And as I expected I have over 4K over payment.....

Panic one, where the hell do I find that?
Panic two, when calling them and a lady looks at notes and investigates when/ why still processing, it's been referred to compliance department.

What happens now? I've not heard anything since, the number she gave me 03000 535 573 just rings out so I've no idea what's going on, what I can do to help, or how I'm going to survive, now 37 weeks pregnant with 4 children one of which has ADHD and neurological deficit....

Has anyone dealt with compliance and know how long this all takes? I've had no more correspondence from anyone for a week, and that was the final award notice for single claim...

Any advice would be great, thank you.

Housing benefit claim terminated

My sister has been claiming housing benefit for the past 3 years. She has just received a letter from them stated her claim has been terminated, the reason being that information requested has not been received.


My sister has not received any request for information from them. I assume they are wanting copy payslips or confirmation of childcare costs which she is able to provide.


She was due a payment of HB this Friday and this leaves her in a pickle financially.


The letter states she may be entitled to benefit based on her new circumstances (nothing has changed financially for her) and she can make a new claim for benefits.


Does anybody know if she phones them on Monday to get confirmation of what information they require and sends this onto them will her claim be reinstated? Or will she have to make a new claim for benefits and re-send all the information they already have eg. tenancy agreement?

I am really worried just received a letter for a customer compliance interview on Saturday, Is it routine or does it mean somebody has reported me?
I split up with partner last august and have a 1 year old then claimed income support he does not live with me. I started a distance learner course but I don't see why this would be an issue as I told a jobcentre advisor about this.

Would anybody know how long you have to be on JSA before you can apply for the scheme?

I have recently (this week) not returned to my job after maternity and waiting to hear about my eligibility for contribution based JSA. I unserstand if you leave a job then you will be put in sanction which i knew when not returning to work due to child care issues and a 50 hour week including travel.

I have been looking at part time work (about 25 hours) as i have all ways worked and want my child to develop in nursery a few days a week.

I have come across the NEA scheme and after an earlier post here a lady commented about her niece starting her own business.

A few years ago i wanted to leave my place of work but not stupid enough to just quit and claim and i had been developing a business idea in my spare time. Luckily a good job came available and i moved sectors.

Now i find myself in a non working position these ideas have come back to me for some serious thought the past few days while job hunting.

If i am now on a sanction could i ask to be put on the NEA scheme to develop a business and offer to still be sanctioned but actually do something with my time other than job hunting? Do you have to be on JSA for a set amount of time? Do you have to be actually claiming the JSA money?

In my eyes if i am not actually recieving JSA surely it would be better for me to be going through the NEA with no need to give me any benefit and get me on the way to working?

I have never been unemployed before so am i looking at my situation and the system with to much hope?

I have a meeting with my advisor on Wednesday and would like to have an idea where i stand before i meet her.

Self-employed claim expenses - does it work like this?

So, I start work on 1 February (in a school) and I'm thinking of also starting tutoring in my spare time. For the tutoring part, I would be self-employed of course.

I read that I can claim expenses such as stationery, advertising (web page costs), computer and so on.

Am I correct in reasoning that if I were to earn £3000 a year and the cost of the aforementioned stationery/advertising/computer is also £3000, I would not pay any taxes at all on this self-employed income?

Also, for the computer to be claimed as an expense, it should be used exclusively for business. How is this determined?

My friend has split up with her husband and moved in with her mum.






Her mum lives in a council house and is a pensioner, she receives full housing benefit and also council tax . My friend works part time and only earns £126 a week, but does have savings etc.


She knows she will have to pay her way, I am assuming in terms of rent housing benefit will be reduced and she will have to pay the non dep charge, but is unsure how much Council tax she will need to pay. I am assuming her mum currently gets the 25 percent discount, which will revert to the full amount. Will her daughter have to pay the 25percent increase or how will it work.

Esa50 form advice

The dreaded esa50 form arrived for my husband this week (in a white envelope). I still have a copy of the form I completed in 2013 when he migrated from incapacity benefit contribution based when he was placed in the support group and copies of most of his consultant and specialist letters.

He has Parkinson's and schizoaffective disorder, takes a lot of medication some of which makes him drowsy, and doesn't relieve the psychosis as if you increase the psychiatric meds it makes the Parkinson's worse and vice versa. He sees two consultants, Parkinson's nurse, and community mental health team regularly.

The form only has space for one person to be named who knows best how his conditions affect him. I don't know who to put as none of them really know how bad day to day life really is.

I was thinking of asking the Parkinson's nurse and the community psychiatric nurse to write a letter to enclose with the form. Is this overkill? Last time we enclosed a letter from the cpn, a typical week diary, meds list and copies of the most relevant clinic outcome letters as well as the completed form. Should I do the same this time?

I am quietly panicking about him losing his esa or even worse him being put in the work related activity group (this would be so much work for me to make sure he did everything he needed to to avoid sanctions and he wouldn't get anything after a year as I work).

I'm also panicking about him having a face to face assessment - he is partly oblivious to how ill and psychotic he is and I'd rather it remained that way than make him face up to it. He also will quite happily say he can do things when he can't, or can't do them safely or repeatedly.

Has anyone else's had a reassessment and avoided a face to face interview?

Inheritence and state benefits...rules?

Ok first a little background. I have had a terrible 18 months. I split from my violent partner and divorced him, he completely ruined me financially (when he left he also destroyed my computer and cut my cards and emptied my bank account so i couldn't pay the bills for a while, I had to make a claim for benefits and I was 2 weeks away from giving birth by c-section and have 4 other children, by the time id sorted my money out and everything I was already in a lot of debt with them, especially catalogues and late payment fees and returned direct debits added to the costs). He emptied most of the house as he saw everything we bought as his and he destroyed most of what he didnt take.

I met a new guy down the line but life kept going down hill. I had emergency gall bladder surgery last April. Next i had another procedure as a stone got stuck. I carried on getting pains which lead to a diagnosis of multiple sclerosis in June last year. In July I lost my mother to lung cancer. In August we moved house and area largely due to my ex husbands threats and bad memories. I carried on getting pains but assumed it was the ms. Recent tests have shown I also have lupus, kidney stones, liver disease and also they've found a tumour on my left kidney.

I gave up working during my last pregnancy as I had hypermesis and havent been able to return as my health is very bad. My partner now also claims benefit to care for me. Because of my ex and also the costs of moving and getting furniture and the costs involved in and out of hospital etc plus my terrible memory due to the ms (not remembering to pay things on time) I have landed in a lot of debt, I owe approximately £12000 to catalogues, credit cards and a loan. It just spiralled out of control and the interest charges mean each payment i make very little comes off.

I am due to inherit approximately £20,000 from my mothers will shortly. I understand the rules around this and i will lose my income support, housing and council tax benefit until it reaches below 16000 (without spending it too quickly). What I want to know is, will I be allowed to use any of this money to pay off some of this debt or will it be classed as deprivation of capital? when i say some i mean more then the weekly payments im able to make now?

I know im unlikely to be allowed to pay off all these debts in 1 go as that would almost certainly be classed as deprivation of capital but would they allow me to atleast pay a few off or a lump sum to them each to reduce the interest on them (im in the red on most of them). I have catalogues ringing me everyday and its really worrying me, im doing my best to make payments but its getting me nowhere with the interest and late payments mounting up, the more I worry the more my ms flares up and i have all these new health worries now.

Can anyone please advise?
